Within the framework of the 5th Session, on the morning of June 5, after listening to the presentations and reports on the review of the draft Law on Credit Institutions (amended) and the draft Law on Housing (amended) in the hall, delegates discussed in groups about the draft Law on Housing (amended).
Conducting group discussions, the majority of opinions highly agreed with the necessity of building a law, but it is necessary to expand the beneficiaries of social housing policies for workers in enterprise clusters.
Delegates assessed that the Draft Law Document was prepared relatively elaborately and thoroughly, basically meeting the requirements of the Law on Promulgation of Legal Documents; in addition, there were opinions suggesting that the drafting agency fully supplement the draft documents detailing the implementation of the Law; continue to research to legalize to the maximum the contents currently stipulated in sub-law documents that are clear, have been tested in practice and have been effective in practice.
Commenting on Clause 9, Article 3 of the draft Law, the delegate suggested that the drafting agency consider only building worker accommodation in industrial parks. Accordingly, for industrial parks that have been established and have no land left to build accommodation, if the regulations are as rigid as in the draft, it will cause difficulties in practice. Therefore, the delegate said that it is possible to stipulate the arrangement and construction of worker accommodation within a certain radius around the industrial park to have a higher openness and be more effective when implemented in practice.

The delegate said that regarding the beneficiaries of social housing support policies, Clause 6, Article 73 stipulates that workers and laborers working at enterprises in industrial parks are entitled to social housing support policies. The delegate said that currently, many enterprise clusters are emerging, developing rapidly, attracting many workers, to ensure sufficient conditions to meet the need for social housing, it is necessary to add more workers, laborers, and experts working at enterprises in industrial parks.
Also in Article 73, Clause 12, it is stipulated that enterprises and cooperatives, in accordance with the provisions of the law on enterprises and cooperatives, rent worker accommodation to sublease to employees in their units according to the provisions in Section 3 of this Chapter. Delegates proposed to add "social housing" to this provision, because the concept of worker accommodation is not included in other provisions.
Delegates reflected that currently, the housing needs of workers in industrial parks are being met, attracting investment in building social housing according to the 2014 Housing Law. Meeting the rental needs of businesses and workers is very important.
In Clause 2 and Clause 3, Article 74 on the form of implementing social housing support policies stipulates that poor and near-poor households residing in urban areas are not entitled to housing support policies.
The delegate said that in reality, in mountainous urban areas, there is not much difference between poor households, near-poor households in rural areas and poor households, near-poor households in mountainous urban areas. If the above regulations are applied, it will be very disadvantageous for poor households, near-poor households in mountainous urban areas. The delegate said that it is necessary to have more open regulations so that all households can enjoy social housing support policies.

Regarding land for social housing construction, Clause 3, Article 80 of the draft law stipulates: The People's Committee at the provincial level is responsible for reporting to the People's Council at the same level on allocating a certain proportion of the revenue from land use fees and land rents of commercial housing and urban area investment projects in the area to carry out compensation, site clearance (if any) and invest in building technical infrastructure systems for social housing investment projects or invest in building social housing projects and workers' accommodation projects in the area.
Delegates said that this provision is unclear and does not specifically quantify the “certain proportion” that is reserved, leading to inconsistency in implementation. Therefore, it is necessary to clearly stipulate the specific proportion to ensure clarity in legal documents, helping localities implement it consistently and synchronously.
The delegate also stated that the construction of workers' accommodation is necessary, however, during construction, it is necessary to take into account the essential needs of the residents, so that the area has supermarkets, schools, medical facilities, social services, and cultural institutions to serve the lives of workers, to gradually form a long-term residential area.
Regarding the renovation of apartment buildings, the delegate stated that there are different views and opinions surrounding the relocation of residents from old and dangerous apartment buildings, especially regarding the rate of consensus in the community to carry out the relocation. The delegate proposed comparing with the provisions of the Law on Implementing Democracy at the Grassroots Level to come up with a reasonable and feasible percentage for practical application.
Regarding the provincial housing development program and plan, delegates agreed with the provisions in the draft Law. However, the development of the provincial housing development program and plan requires the participation of the provincial People's Committee to ensure housing conditions for local people. At the same time, there needs to be a reasonable level of intervention, not excessive administrativeization, and too deep intervention leading to impacts on the development of the local real estate market.
Delegates also proposed reviewing provincial housing development plans and programs, comparing them with other types of planning being implemented such as provincial land use planning and provincial planning to ensure harmony, consistency, and no overlap or conflict, causing difficulties in the implementation process...
