Kon Tum Provincial People's Committee has just issued regulations on conditions, criteria, scale, and area ratio to separate into independent projects to carry out land allocation and land lease to implement projects through land use rights auctions and bidding to select investors to implement projects using land.

Accordingly, the subjects of application are state agencies performing the task of state management of land and agencies performing the function of advising and assisting in state management of land; persons responsible to the State for land use as prescribed in Article 6 of Land Law No. 31/2024/QH15, persons responsible to the State for land assigned for management as prescribed in Article 7 of Land Law 2024; organizations and individuals using land to implement socio-economic development projects through agreements on receiving land use rights.

The land area managed by a State agency or organization that is considered for separation into an independent project must fully meet the conditions, criteria, scale, and ratio, including being consistent with the land use planning, land use plan, master plan, zoning plan, and detailed plan approved by a competent State agency and must determine specific boundaries to ensure the formation and implementation of the investment project; the land area separated into an independent project must include one or more adjacent plots, not divided by plots in the area where the socio-economic development project is implemented through an agreement on receiving land use rights; there are no disputes, complaints, or violations, or there are disputes, complaints, or violations but there have been written resolutions in accordance with the provisions of law; ensuring the ability to connect traffic and technical infrastructure in sync with the master plan of the land area and related existing areas when the project is implemented.

For projects with a scale of less than 5,000 m2, the land area managed by State agencies and organizations must account for 50% or more of the total land area of ​​the project.

For projects with a scale of 5,000 m2 to less than 10,000 m2: The land area managed by State agencies and organizations must account for 40% or more of the total land area of ​​the project.

For projects with a scale of 10,000 m2 to less than 200,000 m2: The land area managed by State agencies and organizations accounts for 30% or more of the total land area of ​​the project.

For projects with a scale of 200,000 m2 or more: The land area managed by State agencies and organizations accounts for 15% or more of the total land area of ​​the project.

The prescribed land area (for the above-mentioned subjects) does not include the area of ​​the protection corridor of works and the land area under the planning of project implementation, works but the land has not been recovered.

At the same time, the Kon Tum Provincial People's Committee stipulates that investment projects using land that have been approved by competent authorities in principle before the effective date of this Decision but have not yet been allocated or leased land by the State shall be implemented as follows: "In case a socio-economic development project through an agreement on receiving land use rights, in which the project implementation area has a land area managed by a State agency or organization that meets the conditions, criteria, scale and area ratio to separate the land into an independent project, the People's Committee at the competent level shall decide on land allocation and land lease to implement an independent project through auction of land use rights and bidding to select investors to implement the project using land in accordance with the provisions of the law on land. The Department of Planning and Investment shall preside over the consideration and consultation on project settlement in accordance with the provisions of the law on investment before organizing the auction of land use rights".
