Kim Oanh Group affirms that there is no 'forgetting' to reserve land for social housing

For several days now, information regarding two residential projects, Cau Do and My Phuoc 4 (Ben Cat town, Binh Duong province ), developed by Thuan Loi Investment and Development Joint Stock Company (a member of Kim Oanh Group), failing to allocate the required 20% of land for social housing development, has been attracting significant public attention.

Following this information, on June 9th, Ms. Dang Thi Kim Oanh, General Director of Kim Oanh Group, affirmed that the land fund for social housing development has been allocated in accordance with legal regulations.

According to Ms. Oanh, the Cau Do residential area (commercially known as Mega City urban area), a project spanning nearly 50 hectares, is being developed by Thien Phu Company. According to the approved land use plan, the proportion of land allocated for housing for low-income earners accounts for 7% of the total residential land area of ​​the project.

In 2014, Thuan Loi Company successfully bid for and received the project. Upon receiving the project, Thuan Loi Company was responsible for implementing the Cau Do residential area according to the approved plan.

On May 31, 2017, Thuan Loi Company sent a letter to the Binh Duong Department of Construction requesting that the social housing ratio remain at 7% as stipulated in Decision 378/QDUBND dated January 24, 2006, of the Provincial People's Committee.

On June 26, 2017, the People's Committee of Binh Duong province issued a document approving Thuan Loi Company's allocation of land for social housing in the Cau Do residential area at a rate of 7%, with the remaining area being included in the increased land fund for transportation compared to the previous plan.

Based on the direction of the Binh Duong Provincial People's Committee, the Provincial Department of Construction has requested the Ben Cat Town People's Committee to guide the company in preparing the 1/500 scale planning adjustment dossier, and at the same time agreed to allocate land for the construction of social housing at a rate of 7%-9%, with the remaining area being included as additional transportation land compared to the previous plan.

On July 6, 2017, Thuan Loi Company submitted a document requesting adjustments to the planning of the Cau Do residential area project. Specifically, the area allocated for social housing was 2.28 hectares, accounting for 9% of the total residential land area, and the area allocated for transportation infrastructure was adjusted from 14.58 hectares to 18.44 hectares, an increase of 2.87 hectares.

"Thus, the total area of ​​land for social housing and transportation increased by 5.15 hectares, accounting for 20.3% of the total residential land area, ensuring compliance with Official Letter 2643/UBND-KTN dated June 26, 2017, of the People's Committee of Binh Duong province," said Ms. Dang Thi Kim Oanh.

Based on that, on July 11, 2017, the People's Committee of Ben Cat town issued a decision approving the detailed planning project (scale 1/500) for the Cau Do residential area according to the social housing ratio approved by the Provincial People's Committee. On December 31, 2021, the People's Committee of Binh Duong province issued a decision approving the adjustment of the investment policy for the Cau Do residential area project, according to which the project includes 276 adjacent social housing units.

Golden Center City project.

In the My Phuoc 4 residential area (commercial name: Golden Center City), the project comprises two zones, My Phuoc 4A (Golden A) and My Phuoc 4B (Golden B), with the planning approved in 2023 and developed by Thien Phu Company. According to the initial plan, the project did not allocate land for social housing or housing for low-income earners.

On February 6, 2006, the People's Committee of Binh Duong province issued a decision approving the revised and expanded detailed planning of My Phuoc 4 residential area, allocating 8.35% of the land for low-income earners. On July 2, 2007, the People's Committee of Ben Cat district issued a decision approving the revised detailed planning project at a scale of 1/2000 for My Phuoc 4 residential area, reducing the percentage of land allocated for low-income earners to 7.58%.

In 2014, Thuan Loi Company won the auction and took over the project along with the Cau Do residential area. After Thuan Loi Company took over the project, the People's Committee of Ben Cat town issued a document approving the allocation of 8% of the total residential land area as a land fund for social housing and approved the Detailed Planning Project (scale 1/500) of My Phuoc 4 residential area – Zone B, allocating 8% of the residential land area for social housing.

"Thus, Thuan Loi Company has allocated land for social housing development in the two residential projects, Cau Do residential area and My Phuoc 4 residential area, in accordance with the planning approval of the Binh Duong Provincial People's Committee," affirmed the General Director of Kim Oanh Group.

Previously, the Inspectorate of the Ministry of Construction issued Conclusion No. 106/KL-TTr on the implementation of allocating land for investment and development of social housing and the management and use of maintenance funds for common areas of apartment buildings in Binh Duong province.

According to the inspection report, the Ministry of Construction determined that some commercial project developers in Binh Duong province had not allocated land for the construction of social housing as required by the Government .

Specifically, a report from the People's Committee of Binh Duong province to the Inspectorate of the Ministry of Construction stated that during the period 2016-2021, 178 commercial housing projects were invested in Binh Duong province. Of these, 17 projects were required to allocate land for social housing construction, while the remaining 161 projects, smaller than 10, chose to pay the State for social housing development instead of allocating land.

Of the 17 projects that are required to allocate land for social housing development, 13 projects are larger than 10 hectares, and 4 projects are smaller than 10 hectares.

During the inspection, the Ministry of Construction discovered that two projects, each exceeding 10 hectares, did not allocate the required 20% of their land for social housing development. These were the Cau Do Residential Area project and the My Phuoc 4 Residential Area, Zone B project. Both projects were developed by Thuan Loi Company.

According to the detailed planning at a scale of 1/500 approved by the Ben Cat Town People's Committee in 2020, the Cau Do residential area project allocates more than 7.5% of its total residential land area for social housing.

In the My Phuoc 4 residential area project, the land area allocated for social housing in two zones (A and B) according to the approved plan accounts for more than 8.1% of the residential land area.
