For many days now, information that the two residential projects Cau Do and My Phuoc 4 (Ben Cat town, Binh Duong) of Thuan Loi Investment and Development Joint Stock Company (member of Kim Oanh Group) have not reserved 20% of the project land fund for social housing development has attracted public attention.
In response to this information, on June 9, Ms. Dang Thi Kim Oanh, General Director of Kim Oanh Group, affirmed that she had arranged land funds for social housing development in accordance with legal regulations.

According to Ms. Oanh, in Cau Do residential area (commercial name is Mega City urban area), the project has a scale of nearly 50 hectares invested by Thien Phu Company. According to the approved land use structure, the proportion of land for building houses for low-income people accounts for 7% of the total residential land area of the project.
In 2014, Thuan Loi Company successfully auctioned and received the project transfer. Upon receiving the transfer, Thuan Loi Company is responsible for implementing Cau Do residential area according to the planning approved by the competent authority.
On May 31, 2017, Thuan Loi Company sent an official dispatch to Binh Duong Department of Construction requesting to maintain the social housing ratio at 7% according to Decision 378/QDUBND dated January 24, 2006 of the Provincial People's Committee.
On June 26, 2017, Binh Duong Provincial People's Committee issued an official dispatch approving Thuan Loi Company to allocate social housing land in Cau Do residential area at a rate of 7%, the remaining area is included in the increased traffic land fund compared to the previous planning.
Based on the direction of the People's Committee of Binh Duong province, the Department of Construction of the province has requested the People's Committee of Ben Cat town to guide the company to prepare a dossier to adjust the 1/500 planning, and at the same time agree to arrange land fund for building social housing at a rate of 7% -9%, the remaining area is calculated into additional traffic land compared to the previous planning.
On July 6, 2017, Thuan Loi Company sent a document requesting to adjust the planning of Cau Do residential area project. In which, the social housing land area is 2.28 ha, accounting for 9% of the residential land area and the traffic land area is adjusted to increase from 14.58 ha to 18.44 ha, an increase of 2.87 ha.
"Thus, the total area of social housing land and traffic land increased by 5.15 hectares, accounting for 20.3% of the total residential land area, ensuring compliance with Official Dispatch 2643/UBND-KTN dated June 26, 2017 of Binh Duong Provincial People's Committee," said Ms. Dang Thi Kim Oanh.
On that basis, on July 11, 2017, Ben Cat Town People's Committee issued a decision approving the Detailed Planning Project at a scale (1/500) of Cau Do residential area according to the social housing ratio approved by the Provincial People's Committee. On December 31, 2021, Binh Duong Provincial People's Committee issued a decision approving the adjustment of the investment policy of Cau Do residential area project, according to which the project has 276 adjacent social housing units.
Golden Center City Project.
In My Phuoc 4 residential area (commercial name is Golden Center City), the project includes 2 areas My Phuoc 4A (Golden A) and My Phuoc 4B (Golden B) approved for planning in 2023 by Thien Phu Company as the investor. According to the initial planning, the project does not allocate land for social housing or housing for low-income people.
On February 6, 2006, the People's Committee of Binh Duong province issued a decision approving the detailed planning to adjust and expand the My Phuoc 4 residential area, in which 8.35% of the residential land area was allocated for low-income people. On July 2, 2007, the People's Committee of Ben Cat district issued a decision approving the detailed planning project at a scale of 1/2000 to adjust the My Phuoc 4 residential area, reducing the residential land ratio for low-income people to 7.58%.
In 2014, Thuan Loi Company won the auction and received the project transfer at the same time as Cau Do residential area. After Thuan Loi Company took over the project, Ben Cat Town People's Committee issued an official dispatch approving the arrangement of 8% of the total residential land area as land fund for social housing and approved the Detailed Planning Project at scale (1/500) of My Phuoc 4 residential area - Area B, arranging 8% of the residential land area for social housing.
"Thus, Thuan Loi Company has arranged land funds to develop social housing in two projects, Cau Do residential area and My Phuoc 4 residential area, in accordance with the planning approval of Binh Duong Provincial People's Committee," affirmed the General Director of Kim Oanh Group.
Previously, the Ministry of Construction Inspectorate issued Conclusion No. 106/KL-TTr on the implementation of land allocation for investment and development of social housing (NOXH) and the management and use of maintenance funds for common ownership of apartment buildings in Binh Duong province.
According to the Inspection Conclusion, the Ministry of Construction determined that some commercial project investors in Binh Duong province did not reserve land for social housing construction according to Government regulations.
Specifically, the report of Binh Duong Provincial People's Committee sent to the Inspectorate of the Ministry of Construction said that in the period of 2016-2021, there were 178 commercial housing projects invested in Binh Duong province, of which 17 projects had to reserve land for social housing construction, the remaining 161 projects with a scale of less than 10 chose to pay money to the State to develop social housing instead of reserving land.
Of the 17 projects required to reserve land for social housing development, 13 projects are over 10 hectares in size and 4 projects are under 10 hectares in size.
At the time of inspection, the Ministry of Construction discovered that two projects with a scale of over 10 hectares did not reserve 20% of the project's land fund for social housing development. These were the Cau Do Residential Area project and the My Phuoc 4 Residential Area project, Area B. Both projects were invested by Thuan Loi Company.
Cau Do residential area project, according to the detailed planning scale of 1/500 approved by Ben Cat Town People's Committee in 2020, the ratio of land for social housing to the total residential land area is more than 7.5%.
My Phuoc 4 Residential Area Project, the land area for social housing in 2 areas (A and B) according to the approved planning accounts for more than 8.1% of the residential land area.
