Continuing the working program at Session 32, on the morning of April 22, the National Assembly Standing Committee gave opinions on the draft Law on Urban and Rural Planning.
Urban and rural planning needs innovative thinking
Authorized by the Prime Minister, presenting the report, Minister of Construction Nguyen Thanh Nghi emphasized that the faster the industrialization and modernization process takes place, the more important the role of urban planning and construction planning is. Planning work must always be one step ahead to plan urban and rural development of each locality, ensuring unified, reasonable and effective development.
As of December 2023, the total number of urban areas nationwide is 902, including: 2 special urban areas, 22 type I urban areas, 35 type II urban areas, 46 type III urban areas, 94 type IV urban areas, 703 type V urban areas. The urbanization rate is estimated at 42.6%.
100% of cities, towns and townships have approved general planning; zoning planning in special urban areas and type 1 urban areas is estimated at about 79%, in the remaining urban areas it is estimated at about 55% compared to urban construction land.
According to Mr. Nguyen Thanh Nghi, urbanization is an inevitable process, an important driving force for rapid and sustainable socio-economic development in the coming time. Harmoniously combining the process of urbanization, urban development with industrialization, modernization, new rural construction, ensuring close connection between urban and rural areas in the urbanization process is extremely necessary.
“Therefore, urban and rural planning work needs to have innovative thinking and needs to be regulated uniformly in the same law to ensure consistency, efficiency, and ease of implementation in practice,” according to Mr. Nguyen Thanh Nghi.
The Government affirmed that the promulgation of the Law on Urban and Rural Planning is extremely necessary to institutionalize the Party's leadership orientation for urban and rural planning; planning work with innovative thinking and strategic vision, promoting the distinct potential, outstanding opportunities, and competitive advantages of the locality, province, and region.
The promulgated law will be an effective, efficient, synchronous, unified legal tool, comprehensively regulating urban and rural planning activities, serving socio-economic development, environmental protection, ensuring national defense, security and international integration; at the same time, unifying legal regulations on planning in urban and rural areas in one set of laws, facilitating implementation and effective management.
Eliminate term-based thinking and "group interests"
During the preliminary review, Chairman of the Economic Committee Vu Hong Thanh said that the Standing Committee of the Economic Committee agreed on the necessity of promulgating this law. The consolidation of regulations on urban planning and rural planning into one law is appropriate, aiming to ensure unity in the general direction in controlling, managing, and developing urban and rural areas, harmoniously developing and connecting urban and rural spaces, complementing the overall development of localities, regions, and the whole country.
Regarding the orientation of law-making content, the Economic Committee emphasized the need to ensure that urban planning must have a suitable vision, be strategic, respect market rules and principles of sustainable development.
“Urban planning and infrastructure development of urban areas must be one step ahead and create the main resources for urban development; associated with urban development models, demonstrating the characteristics of new urban models,” according to Mr. Vu Hong Thanh.
The review agency also proposed clarifying the relationship between types of planning in the urban and rural planning system, the relationship between plans in the urban and rural planning system and plans in the national planning system and specialized technical plans.
Clearly define the position and role of planning types and levels, ensure connectivity and connection, avoid overlap, duplication, and conflicts in content between plans, causing waste of resources, difficulties in management, and creating barriers to socio-economic activities of people and businesses;
“Resolutely eliminate the mindset of tenure, the mechanism of “asking - giving”, “group interests” in building, adjusting and supplementing planning, leading to the situation of “suspended” projects and slow implementation in reality”, Mr. Vu Hong Thanh emphasized.
Along with that, review specific regulations on the content of planning types and levels in the direction: for general planning, it is necessary to ensure "dynamic", open, and oriented nature, instead of "rigid", narrowing the development space of urban and rural areas; for zoning and detailed planning, it is necessary to ensure specificity, rationality, feasibility, and convenience for the implementation process...
