During the discussion in the assembly hall, delegate Phan Thi Nguyet Thu affirmed that, in recent times, along with proactively combating, detecting, initiating, investigating, prosecuting, and handling various types of crimes and violations of the law, many indicators in the field of justice have met and exceeded the targets set by the National Assembly.
The prosecuting authorities handled and resolved numerous civil and administrative disputes. In 2023, they resolved 468,828 civil cases and 12,162 administrative complaints, an increase of 24,832 cases compared to the same period in 2022. Courts and procuratorates at all levels implemented various solutions and guided the parties involved in providing evidence, including actively conducting successful mediation and dialogue in 80,440 cases.

Since the 14th National Assembly passed the Law on the Organization of Mediation and Dialogue in Courts, which came into effect on January 1, 2021, it has created a legal mechanism for people to choose mediation and dialogue as a method to resolve disputes and complaints in court in a flexible, appropriate, and time-saving manner, saving costs and effort for the State, organizations, and individuals.
Particularly when mediation and dialogue are successful, the relationship between the two parties is mended, fostering greater unity within the community and significantly reducing the number of cases requiring resolution by the courts and enforcement agencies. According to the report of the Chief Justice of the Supreme Court, 119,058 cases out of 129,856 petitions resulted in parties agreeing to mediation, achieving a rate of 91.68%.
However, delegate Phan Thi Nguyet Thu noted that surveys at several local courts still show that people, when filing applications, refuse mediation and dialogue, despite court officials persistently guiding and explaining the benefits that people would receive from the superior policy of mediation and dialogue.
Therefore, delegates proposed continuing to strengthen the dissemination and education of laws in general, and the Law on Mediation and Dialogue in Court in particular, highlighting its superior benefits to encourage people to proactively choose mediation and dialogue in court when resolving disputes. At the same time, they emphasized the responsibility of organizations and individuals providing legal advice in guiding and explaining to people so that this method of dispute resolution becomes increasingly popular.

On the other hand, delegates suggested the need for adequate investment in facilities, equipment, and dialogue rooms in accordance with regulations, especially equipment for online mediation and dialogue. Reports and surveys from several localities show that the current situation of the offices of district-level courts and procuratorates in many places is dilapidated but has not been rebuilt or repaired.
According to court reports, there are currently 278 dilapidated district-level court buildings lacking courtrooms and mediation rooms, requiring new construction but lacking allocated funds. Therefore, the representative requested that the National Assembly, the Government, and relevant ministries and agencies pay attention and allocate funds to meet the requirements for carrying out assigned tasks.
Furthermore, delegate Phan Thi Nguyet Thu also suggested the need for mechanisms and policies regarding the team of mediators. Currently, there are over 3,000 mediators, including retired judges, clerks, lawyers, and legal aid assistants. This team possesses extensive experience and high prestige within the community. According to Decree 16/2021/ND-CP on mediation fees at courts and mediator remuneration, some cases where mediation fails receive 500,000 VND per case, while successful mediation receives a maximum of 1,500,000 VND per case. However, many civil and administrative cases require persistent mediation and investigation, involving multiple meetings and discussions with the parties involved. Therefore, attention, encouragement, and recognition from relevant agencies and organizations are necessary.
