The Ministry of Health has just issued Circular 1/2023/TT-BYT regulating the implementation of smoking-free locations and awarding of smoke-free environment awards, effective from August 1.
According to Circular 1/2023/TT-BYT, places where smoking is completely prohibited indoors and within the premises include: medical facilities; educational facilities; childcare, nurturing, entertainment and recreation facilities specifically for children; facilities or areas with high risk of fire and explosion (as prescribed in Appendix 2 of the list of facilities with fire and explosion hazards issued with Decree No. 136/2020/ND-CP dated November 24, 2020).
There are 4 locations, completely no smoking areas indoors and on campus.
Places where smoking is completely prohibited indoors include: indoor workplaces of state administrative agencies, public service units, enterprises, political organizations, socio-political organizations, social organizations, socio-professional organizations and workplaces of other agencies, organizations and units.
Indoor areas of public places, including: food service establishments, entertainment service establishments, train stations, wharves, bus stations, religious and belief establishments, conference centers, shopping centers, markets, theaters, cultural houses, cinemas, circuses, clubs, sports halls, stadiums, community activity houses and common living areas of apartment buildings and other public places.
Public transport vehicles that are completely non-smoking include: cars, airplanes, and trains. No smoking signs are placed in the cockpit so that everyone sitting in the public transport vehicle can easily see them, and at the entrances and exits.
The above Circular also stipulates places where indoor smoking is prohibited but where separate areas for smokers are allowed: airport isolation areas; bars, karaoke bars, dance clubs; hotels, motels, guesthouses, resorts and other tourist accommodation establishments; public transport such as ships and trains.
Areas designated for smoking must have signs indicating the smoking area.
Rooms reserved for smokers must be separate and have their own ventilation; doors must not be opened, vented, or discharged into non-smoking rooms or areas, or hallways shared with other rooms; must have items to contain cigarette butts and ashes; must have fire prevention and fighting equipment in accordance with the law on fire prevention and fighting.
On ships, designated smoking areas are arranged on deck or in separate rooms that meet the above requirements.
The designated smoking area on the train should be located at the end of the train, not in the connecting area between two passenger cars.

Circular 1/2023/TT-BYT applies to agencies, organizations and individuals involved in the implementation of smoke-free locations and also regulates the awarding of tobacco-free environment awards.
