Based on Decrees No. 114/2024/ND-CP, No. 50/2025/ND-CP amending and supplementing Decree No. 151/2017/ND-CP, along with previous guiding documents, the Ministry of Finance has set out principles for handling public property When reorganizing administrative units, the overarching goal is to prevent public assets from being lost or wasted.
Agencies, organizations and units subject to reorganization must conduct an inventory, classify and make a list of existing public assets, and coordinate with competent authorities to develop a handling plan. The handover and receipt of assets must comply with regulations and be carried out according to the unified form issued with Decree 151/2017/ND-CP.
Notably, in cases where assets continue to be used for public purposes within the new administrative unit, it will not be necessary to re-implement the house and land handling process according to Decree 03/2025/ND-CP, contributing to simplifying administrative procedures.
One of the major orientations of the Ministry of Finance is to make the most of existing working headquarters and operational facilities. Accordingly, the headquarters of district-level agencies (after abolishing the district level) will be prioritized for arrangement with administrative unit grassroots level or state agencies in need. Many units can share the same headquarters with flexible management methods, suitable to the reality of each locality.
Headquarters and public facilities that are no longer in use will be handled by converting their functions to serve community purposes such as schools, hospitals, libraries, parks, or assigned to units with the function of real estate management and exploitation in accordance with regulations.
For cars, machinery, equipment and other types of public assets, the handling principle is clearly defined: the unit that receives the task will receive the corresponding assets to ensure continuity in work. In particular, if the arrangement leads to a change in the working location of cadres and civil servants, it is possible to use existing vehicles or supplement or rent transportation vehicles according to regulations to ensure that civil servants complete their tasks while still being economical and effective.
For machinery and equipment that are shared or commonly used, the Ministry of Finance's guidance emphasizes the priority of transferring them to new units for continued use. In case of surplus assets, they will be reconciled among local units or handled in accordance with legal procedures on management and use of public assets.
The People's Committee at the district level is responsible for developing a plan for handling public assets during the process of preparing the Project for rearranging commune-level administrative units. In case a commune-level administrative unit is transferred to another district, the receiving district will be responsible for developing a plan for the assets of that unit.
At the provincial level, the Department of Finance shall preside over and coordinate with relevant agencies to develop a master plan to submit to the Provincial People's Committee for approval, ensuring consistency and synchronization with the plan to reorganize administrative units.
Ministries and central agencies with vertical units in the reorganized area must also review their organizational structure. Public assets, headquarters area... If there is surplus assets, it is necessary to transfer them to the locality or transfer them reasonably to other units in the same area to avoid waste.
The Ministry of Finance emphasized that during the implementation process, if localities, ministries and branches encounter difficulties or problems, they need to promptly send documents to the ministry for guidance according to their authority or synthesize and submit to competent authorities for consideration and decision.
This guidance not only facilitates the process of reorganizing administrative units at all levels under the direction of the Government, but also makes an important contribution to the strict management and effective use of public assets - one of the key factors to develop a modern, streamlined, effective and efficient administration.
