In the context of complex developments in the crime situation and changes in the investigation organization model, the two-level People's Procuracy of Phu Yen has proactively implemented many appropriate solutions, strived to fulfill its prosecution responsibilities, closely supervised the handling of crime information, and ensured that reports were handled in accordance with the law.
Tighten control right from the "first door"
According to the Provincial People's Procuracy, from October 2024 to March 2025, the two-level People's Procuracy of Phu Yen exercised the right to prosecute and supervise the handling of 905 reports and denunciations of crimes (a decrease of 102 reports compared to the same period). Of these, 733 reports have been resolved by the investigation agency, while 172 reports are in the process of being processed.
It is noteworthy that the provincial Procuracy has issued 496 documents requesting inspection and verification, clearly demonstrating its proactive and close role in supervising investigation activities right from the beginning, contributing to preventing the risk of wrongful convictions or missing crimes that may arise during prosecution and investigation. The Procuracy has also requested the cancellation of a decision not to prosecute a case, and the investigation agency has accepted and issued a decision to prosecute as requested; at the same time, it requested to prosecute another case, which the investigation agency has accepted and prosecuted as requested.
Head of the Provincial People's Procuracy Pham Trung Thuan shared: With its responsibility as a prosecutor, the industry is always cautious and responsible so that every decision to prosecute or not prosecute must have a basis, not letting criminals escape or allowing injustice to happen.
From proactively issuing hundreds of verification requests, to directly recommending to correct violations and promoting the signing of inter-sectoral coordination regulations, it shows that the work of prosecution and supervision of handling information about crimes in Phu Yen is adapting to the new organizational model of the investigation force, while affirming the role of "gatekeeper of justice" of the Procuracy.
Not only conducting inspections on records, the Provincial People's Procuracy also directly organized 3 inspections at the Investigation Agency to comprehensively assess the acceptance and handling of information about crimes. Thereby, the unit issued 11 recommendations requesting to correct violations and 6 recommendations for prevention, all of which were seriously accepted and implemented by the investigation agency. In addition, the Provincial People's Procuracy also issued 2 notices to draw lessons, enhanceeducation , and prevent errors in litigation activities.
In addition, the responsibility of the prosecution is also clearly demonstrated in the consideration and approval of preventive measures. This is an important stage that directly affects human rights and civil rights. The requirements for verification and analysis of evidence are emphasized to both serve the purpose of handling the right person and the right crime, and to prevent errors that can lead to wrongful convictions.
Responding to new demands from practice
In the current period, an urgent requirement for the work of supervising and handling crime information sources is the lack of organization of district-level police investigation agencies, while the crime situation is increasingly sophisticated and diverse. In response to this reality, at the end of March, the Provincial People's Procuracy and the Provincial Police proactively signed a coordination regulation in the work of receiving, classifying, and handling denunciations and reports of crimes and recommending prosecution; investigating criminal cases against investigators and investigation officers assigned to commune, ward, and town police.
The Director of the Provincial People's Procuracy, Pham Trung Thuan, said: The coordination regulations between the two sectors were signed to ensure that the criminal proceedings take place continuously, in accordance with the law, and in response to the current practical situation. This coordination regulation not only clarifies the roles and responsibilities of each sector, but also creates a legal corridor for smooth coordination between the prosecution and investigation without interruption, overdue or omission of tasks or cases being handled, with the ultimate goal of handling the right people, the right crimes, and the law, maintaining legal discipline, and fulfilling the political tasks of the sector and the locality.
In addition to professional work, the Provincial People's Procuracy also pays special attention to training and fostering skills for the team of prosecutors, especially in the field of criminal information prosecution. Along with that, the application of information technology in receiving, managing and monitoring reports is also actively deployed by the Phu Yen Procuracy. This not only improves professional efficiency but also helps prosecutors control the progress and quality of handling reports quickly, objectively and accurately.
