(Fatherland) - Cultural heritage is a valuable asset of each country, reflecting the history, identity and cultural quintessence of the nation. Protecting and promoting the value of cultural heritage is not only the task of the State but also requires the participation and contribution of the whole society. This was affirmed at the seminar "Improving mechanisms and policies to mobilize social resources to protect and promote the value of cultural heritage" recently organized by the People's Representative newspaper.
According to the program of the 8th Session of the 15th National Assembly, the draft Law on Cultural Heritage (amended) is expected to be considered and approved by the National Assembly on November 23, expected to create a boost in mobilizing social resources to preserve and promote heritage values.
Remove bottlenecks
Deputy Director of the Department of Cultural Heritage (Ministry of Culture, Sports and Tourism) Tran Dinh Thanh said that although socialization activities in the field of heritage have been promoted and developed evenly, in the face of practical difficulties and obstacles, the legal system needs to be amended, supplemented and perfected.
Overview of the Seminar
The current Law on Cultural Heritage only stipulates that the State “encourages domestic and foreign organizations and individuals to contribute and sponsor the protection and promotion of cultural heritage values”. According to Mr. Tran Dinh Thanh, in order to promote and effectively mobilize social resources, there must be further adjustments and improvements to the legal corridor. “Cultural heritage is an extremely scientific field, so the Law on Cultural Heritage sets out principles and regulations that when affecting cultural heritage, scientific factors must be ensured. However, at present, the principles are not clear, hindering socialization activities…”- Mr. Tran Dinh Thanh shared.
Since 1998, the Party and State have had a policy of socialization, hoping to mobilize resources from society, using relics to nurture relics, using culture to nurture culture... Many policies have been issued, but Associate Professor, Dr. Bui Hoai Son, Standing Member of the National Assembly's Committee on Culture and Education, frankly pointed out that the bottlenecks have not been completely removed. Therefore, the draft Law on Cultural Heritage (amended) is expected to create an effective legal corridor.
“The highlight of the draft Law is the clear regulation of ownership rights, including ownership by the entire people, common ownership and private ownership. Based on that ownership rights, it will create conditions for other activities related to business or organization of service activities. In addition, there are specific regulations, creating maximum conditions for organizations, businesses and individuals to participate in activities to protect and promote heritage values... We expect to create a synchronous and open legal corridor to facilitate activities to protect and promote heritage values”, Associate Professor, Dr. Bui Hoai Son commented.
One of the three policies focused on in this Law is to strengthen the content, mechanisms, and policies to promote socialization and attract and improve the efficiency of mobilizing resources to protect and promote the value of cultural heritage. This is considered particularly meaningful in the context of the Cultural Development Strategy to 2030, which affirms the view that building and developing culture is the cause of the entire people, creating more resources to protect and promote cultural values, and creating a driving force for the development of a prosperous and happy country.
Accordingly, the draft Law on Cultural Heritage (amended) stipulates more clearly the mechanisms and policies, including a separate article on socialization in protecting and promoting the value of cultural heritage; at the same time, it stipulates public-private cooperation in the field of cultural heritage. This not only demonstrates the State's interest in encouraging and creating conditions for individuals and organizations to participate in protecting and promoting the value of cultural heritage; but also creates trust and motivation for the whole society to join hands in caring for the cause of cultural development. Thereby, mobilizing non-State resources to protect and promote the value of cultural heritage together with State resources, thereby contributing to the socio-economic development of the locality as well as the country in general.

Mobilizing social resources for the protection and promotion of cultural heritage values
Ninh Binh is considered a locality that has done a very good job of mobilizing social resources for the protection and promotion of cultural heritage values, especially in the case of Trang An Scenic Landscape Complex - World Cultural and Natural Heritage. Director of Ninh Binh Department of Tourism Bui Van Manh said: The province is determined, persistent, and steadfast in its orientation of developing tourism associated with heritage protection. To do that, Ninh Binh makes the most of and mobilizes investment resources in infrastructure, as a basis to attract and encourage businesses and local communities to participate in investing in the restoration and promotion of cultural heritage values.
After being recognized by UNESCO, Ninh Binh issued Resolution No. 02-NQ/TU dated August 17, 2016 on preserving and promoting the value of the World Cultural and Natural Heritage of Trang An Scenic Landscape Complex in tourism development in the period of 2016 - 2020. Accordingly, clearly defining the responsibilities of departments, branches, sectors, and enterprises, as a basis for mobilizing social resources to participate in preserving the relics and heritages that have been zoned for protection.
Ninh Binh also issued policies to support the repair of houses in heritage areas and the construction of new houses in traditional architecture. In addition, the province takes the community-based model as the main foundation for tourism development. Currently, there are about 10,000 direct workers who are directly benefiting from heritage conservation. This is the main point that makes UNESCO evaluate Trang An as a model of harmonious development between heritage conservation and connecting and ensuring livelihoods for local people. The province also maximizes the cooperation and support of international organizations in archaeological research, improving community capacity in heritage management, supporting the development of products in heritage areas, etc.

"The lessons of Trang An Scenic Landscape Complex have many successes but also many difficulties due to mechanisms and policies. We have never dared to accept it as a public-private partnership model as its concept. We only define this as a 3-party cooperation model between people - businesses and the state, and are adding a 4th party, scientists", Mr. Bui Van Manh shared.
Looking at the whole country, according to Mr. Tran Dinh Thanh, since the Law on Cultural Heritage was promulgated in 2001, socialization activities in the field of cultural heritage have been promoted.
Mr. Tran Dinh Thanh affirmed that in all four areas of cultural heritage including tangible cultural heritage, intangible cultural heritage, museums and documentary heritage, social resources have contributed greatly to conservation, preservation, protection, and then promoting values. Up to now, these resources are equivalent to State resources in protecting and promoting the value of cultural heritage.

"If we separate the role of the community, cultural heritages will exist in a forced manner. That is why the role of the State, although extremely important up to now, cannot be without the role of the community or other stakeholders," Associate Professor, Dr. Bui Hoai Son emphasized.
According to Associate Professor, Dr. Bui Hoai Son - Standing Member of the Committee for Culture and Education, the important purpose of amending the Law on Cultural Heritage this time is to unleash social resources, thereby better protecting and promoting heritage values. Because only with the cooperation of the whole society can the work of protecting and promoting heritage values be sustainable.
