When downsizing, are employees entitled to unemployment benefits?

When leaving work during the downsizing process, employees are very interested in support policies, including unemployment benefits.

In the context of agencies and units streamlining staff and restructuring the organizational structure, employees are very interested in the policies if they have to quit their jobs.

Based on current regulations of Social Insurance (SI), when streamlining the apparatus, if an employee participates in unemployment insurance and quits his job, he will receive unemployment benefits; but if he is a civil servant who does not pay unemployment insurance, he will not receive this benefit.

Specifically, civil servants, public employees, and workers who quit their jobs and participate in social insurance will receive a 3-month salary allowance to find a job, and after 1 year of stopping paying social insurance, workers can make a one-time social insurance payment if eligible.

According to Decree 178/2024/ND-CP, employees subject to downsizing when leaving their jobs will receive severance pay, allowance for each year of compulsory social insurance payment, allowance for finding a job or unemployment insurance.

These are important aids that help workers have more time and resources to find new jobs that suit their abilities and circumstances.

Mr. Do Ngoc Tho, Head of the Social Insurance Policy Implementation Department (Vietnam Social Insurance), said that when employees participating in unemployment insurance quit their jobs, they will enjoy policies on unemployment benefits, vocational training, job referrals, etc.

"The Unemployment Insurance Fund currently has a surplus of more than 60,000 billion VND. Therefore, for officials and employees who quit their jobs when the apparatus is streamlined, the Unemployment Insurance Fund still ensures the ability to pay," Mr. Tho affirmed.

Employees who quit their jobs due to the process of streamlining the apparatus, if they need to receive unemployment insurance benefits, can submit their application directly at the local Employment Service Center system, or through the National Public Service Portal.

What benefits do non-professionals enjoy?

According to Conclusion 137-KL/TW of the Secretariat dated March 28, 2025 on the arrangement and reorganization of commune-level administrative units, the use of part-time workers at the commune level will end. Accordingly, part-time workers at the commune level who implement staff streamlining will receive the following allowances:

- For non-professional workers at the commune, village, and residential group levels holding elected positions: For each month of retirement before the end of the term, they will receive a subsidy equal to half of the current monthly allowance. For those who retire before the end of the arrangement roadmap, the number of months of subsidy will be calculated by the number of months of retirement before the retirement date mentioned above;

- For non-professional workers at the commune, village, and residential group levels holding non-elected positions: For each month of retirement before the end of the placement roadmap, they will receive a subsidy equal to half of the current monthly allowance. For those who retire before the end of the placement roadmap, the number of months of subsidy will be calculated by the number of months of retirement before the retirement date mentioned above.
