At the meeting, ministries and branches reported on the progress of drafting legal documents, especially documents serving the arrangement and streamlining of the apparatus, the arrangement of administrative units, and the organization of two-level local governments; the implementation of Resolution 57 of the Politburo on breakthroughs in science and technology development, innovation and digital transformation, related to handling difficulties in socio-economic development, ensuring growth targets.
"The most important thing in organizing a two-level local government is to define the authority and power of the district level. After the district level is removed, what should go up to the province and what should go down to the commune level," said Minister of Justice Nguyen Hai Ninh. It is necessary to specifically decentralize the contents from the Government, Prime Minister, Ministers, and specialized ministries to the provincial level.

In the near future, when localities establish new provincial and communal levels, they must know who has the authority of the district level, what the province does, what the commune does, and what the Central Government has delegated to the provincial level. The Minister proposed that each ministry should develop a decree on the division of authority in the areas under its management. For example, the Ministry of Finance, how to delegate state budget management to the provincial and communal levels.
Deputy Minister of Finance Le Tan Can said that after reviewing documents in line with the direction of amending the Constitution, the Ministry of Finance needs to amend 195 legal documents. "The volume is very large. Currently, units of the Ministry of Finance work day and night, including Saturdays and Sundays," said Mr. Le Tan Can.
According to Deputy Minister of Agriculture and Environment Vo Van Hung, time is very urgent, we can only discuss and do, we cannot postpone. In arranging and organizing the 2-level government apparatus, we need to pay attention to the implementation of national target programs and key projects to ensure a smooth transition without interruption.

Deputy Inspector General of the Government (GIG) Le Tien Dat said that the GIG is urgently drafting the Law on Inspection (amended) to meet the requirements of rearranging the system of inspection agencies according to the conclusions of the Politburo and the Secretariat. The GIG submitted the draft Law to the Government on March 28 to submit to the National Assembly at the 9th Session. This Law amends the provisions of a number of specialized laws on the functions of ministerial inspectors.
Reporting on the review process, Deputy Minister of Justice Nguyen Thanh Tu said that ministries, branches and localities have reviewed 19,224 documents regulating the functions, tasks, powers, organization and operation of local governments, agencies, organizations, units and competent positions at district and commune levels and a number of other issues related to district and commune levels that need to be studied and determined for handling in accordance with the direction of amending and supplementing a number of articles of the 2013 Constitution.
To effectively carry out the review and remove obstacles and shortcomings, the Ministry of Justice has established a working group on receiving and handling feedback and recommendations to improve the law. The Ministry has built an information system for receiving and handling feedback and recommendations on legal documents for trial operation.

"No time to back down"
Concluding the meeting, Deputy Prime Minister Le Thanh Long emphasized that the work ahead is huge. The Government Office needs to draft a document to submit to the Prime Minister to assign specific tasks to ministries and branches with specific deadlines because "there is no more time to delay". The ministries and branches continue to review and send to the Ministry of Justice for synthesis.
Noting the principles, viewpoints, and methods of handling legal documents on the arrangement and organization of the apparatus, the Deputy Prime Minister asked the Ministry of Justice to study new proposals as well as some specific mechanisms such as handling planning issues.
For new documents submitted after April 1, 2025, the Law on Promulgation of Legal Documents 2025 will apply. Accordingly, the process will be simpler, but the responsibilities of Ministers and Industry Heads will be heavier and must be followed to the end.
Regarding documents to be submitted at the 9th Session of the 15th National Assembly (scheduled to open in early May) related to the arrangement and organization of the apparatus, the implementation of Resolution 57 of the Politburo on breakthroughs in science and technology development, innovation and digital transformation, and the handling of difficulties in socio-economic development and ensuring growth targets, ministries and branches must submit them to the Government before April 6.
The Ministry of Science and Technology needs to focus highly on completing draft laws to institutionalize Resolution 57 of the Politburo, ensuring completeness, comprehensiveness, and coverage of issues arising in the process of restructuring and organizing the apparatus.
