Recently, social networks have been stirred up with many scandals related to charity calls, especially celebrities calling for charity online, causing a lot of public opinion about transparency. The most notable recent case is the charity scandal between TikToker Pham Thoai and Bap's mother.
Regarding this issue, a citizen sent a question to the Ministry of Public Security with the following content: Through social networks Facebook and Zalo, is it illegal for individuals to call for support for cases of serious illness, traffic accidents, kidney dialysis, poverty... using their personal accounts?
Are there specific regulations for calling for support using personal accounts? Does the individual have to prove the amount of money people donate?
Regarding the above issue, the Ministry of Public Security said that the mobilization, reception, distribution and use of voluntary contributions to support overcoming difficulties caused by natural disasters, epidemics, incidents, and support for patients with serious illnesses are carried out according to the provisions of Decree No. 93 of the Government .
The State encourages, honors and creates favorable conditions for organizations and individuals to participate in voluntary contributions and organize voluntary contribution mobilization.
The law does not prohibit individuals from calling for support for cases of serious illness, traffic accidents, kidney dialysis, poverty... using their personal accounts via social networks Facebook and Zalo for humanitarian purposes.
However, it must be public, transparent, for the right purpose, to the right audience and implemented in accordance with the provisions of Decree No. 93 of the Government.
In case of fraudulent behavior (making up stories, falsifying information, impersonating victims...) to appropriate property, use donated money for the wrong purpose or misappropriate it, causing negative impacts on security, order, and public opinion, depending on the nature and severity, the violating individual will be subject to administrative sanctions.
Or criminally prosecute crimes under the provisions of the Penal Code such as fraud to appropriate property, "Abuse of trust to appropriate property"...
According to the Ministry of Public Security, calling for support through personal accounts is carried out in accordance with the provisions of Section 2 and Section 4 of Decree No. 93 of the Government.
Individual campaigners must open a separate bank account for each campaign to receive and manage all voluntary contributions.
In addition, it is responsible for opening a book to record full information on the results of receiving and distributing voluntary contributions according to the supported subjects and areas.
Finally, the individual campaigner must publicly disclose the results of use to prove the total amount of money mobilized and used.
Major General To Cao Lanh - Deputy Director of the Department of Investigation Police on Social Order Crimes (Ministry of Public Security) said that the Ministry of Public Security will receive and handle when individuals and organizations send reports of crimes related to illegal acts when calling for charity.
Major General Lanh recommends that people be vigilant and carefully verify information before deciding to make charitable contributions to avoid being scammed by bad guys and criminals.
Check information carefully and prioritize contributions to reputable charities and social organizations that are licensed by competent authorities and operate transparently.
