The Ministry of Agriculture and Rural Development has just issued a Circular guiding the maintenance and repair of dikes and the emergency handling of dike incidents. Accordingly, regarding the process of planning dike maintenance and repair using central government budget funds, it is necessary to maintain and repair dikes to ensure safety, prevent degradation, and meet the requirements of flood and storm prevention. The Department of Agriculture and Rural Development shall organize the preparation of dike maintenance and repair plans before June 15th of each year and submit them to the Department of Dike Management and Disaster Prevention for review and compilation.

Based on the total budget allocated by the Ministry of Agriculture and Rural Development for dike maintenance and repair, the current state of dikes, and the specific characteristics of each locality, the Department of Dike Management and Disaster Prevention and Control approves the budget, including the budget for dike maintenance and repair plans of localities implemented by the Department of Agriculture and Rural Development; and the total budget for emergency (urgent) dike incident handling. Based on the approved budget, the current state of dikes, technical standards and regulations, unit prices, norms, and current regulations, the Department of Agriculture and Rural Development organizes the preparation of a project or economic-technical report (for contents with a construction component) or prepares a proposal and budget estimate (for contents without a construction component), and submits it to the Department of Dike Management and Disaster Prevention and Control for appraisal and approval.

After the project, economic-technical report, or outline-estimate is approved, the Department of Agriculture and Rural Development prepares a contractor selection plan, submits it to the Department of Dike Management and Disaster Prevention and Control for approval, and organizes the implementation of subsequent steps, ensuring compliance with the law on construction and bidding. Regarding the work organized by the Department of Dike Management and Disaster Prevention and Control: Based on the approved budget, requirements, management tasks, technical standards and regulations, unit prices, norms, and current regulations, the Department of Dike Management and Disaster Prevention and Control organizes the preparation, appraisal, and approval of the outline-estimate and approves the contractor selection plan for implementation. When a dike incident is detected, the specialized agency responsible for state management of dikes under the Department of Agriculture and Rural Development will inspect the specific location of the incident and report in writing, proposing solutions for handling it. The Department of Agriculture and Rural Development organizes the inspection of the incident, reports, and advises the Provincial People's Committee to direct relevant agencies to implement solutions to ensure dike safety and reports to the Ministry of Agriculture and Rural Development through the Department of Dike Management and Disaster Prevention and Control. Based on the report of the Provincial People's Committee, the Department of Dike Management and Disaster Prevention and Control conducts on-site inspections and provides written opinions on the handling policy and funding for the incident. After receiving written opinions from the Department of Dike Management and Disaster Prevention and Control on the handling policy and funding, the Provincial People's Committee directs the Department of Agriculture and Rural Development to prepare an emergency (urgent) handling plan (project) to be submitted to the Department of Dike Management and Disaster Prevention and Control for appraisal and approval before implementation. The required documents are specified in Appendix III attached to this Circular. The Department of Agriculture and Rural Development is responsible for submitting to the Chairman of the Provincial People's Committee a decision to declare a state of emergency due to natural disasters, as stipulated in Article 12 of Government Decree No. 66/2021/ND-CP dated July 6, 2021, detailing the implementation of several articles of the Law on Disaster Prevention and Control and the Law amending and supplementing several articles of the Law on Disaster Prevention and Control and the Law on Dikes, in order to organize the emergency (urgent) handling of dike incidents. The implementation of the emergency (urgent) project to handle dike incidents shall be carried out in accordance with Article 13 of Decree No. 66/2021/ND-CP. In the event of detecting dike failures during storms or floods, immediate repairs are necessary to ensure the safety of the dike system. The Department of Agriculture and Rural Development shall report to the Provincial People's Committee to implement timely rescue measures, and then complete the dossier for submission to the Department of Dike Management and Disaster Prevention and Control for approval. The preparation and implementation of dike maintenance and repair plans and emergency (urgent) dike failure response plans from local budgets shall be carried out according to the guidance of the Provincial People's Committee and current regulations.Dan Hung
