Instructions on salary classification for commune-level cadres with intermediate vocational and college degrees
According to Point c, Clause 1, Article 6 of the 2019 Law on Education, intermediate and college levels are training levels belonging to the vocational education level of the national education system.
The Law on Vocational Education 2014 stipulates the vocational education system applicable to all secondary schools and colleges.
At the same time, the Law on Vocational Education 2014 replaces the Law on Vocational Training 2006, which stipulates that there is no distinction between training institutions, training types and state management agencies for vocational education (the Law on Vocational Training 2006 stipulates that vocational intermediate schools and vocational colleges are under the management of the Ministry of Labor - Invalids and Social Affairs to distinguish them from professional intermediate schools and colleges under the management of the Ministry of Education and Training according to the provisions of the Law on Higher Education 2012).
In Article 5 of Decree 92/2009/ND-CP on titles, numbers, some regimes and policies for cadres, civil servants in communes, wards, towns and non-professional workers at the commune level (amended and supplemented in Decree 34/2019/ND-CP), commune-level cadres who have graduated from intermediate level or higher in professional training are paid as administrative civil servants as prescribed in salary table No. 2 issued with Decree 204/2004/ND-CP.
Circular 13/2019/TT-BNV guiding a number of regulations on commune-level cadres, civil servants and part-time workers at the commune level, in villages and residential groups stipulates commune-level cadres and civil servants:
+ Graduates with professional training and college level salary is classified according to the staff rank (applicable to civil servants type A0);
+ Graduates with intermediate professional and technical qualifications are classified according to the employee grade (applicable to civil servants of type B) according to the provisions of Article 9a of Circular 11/2014/TT-BNV, amended and supplemented in Clause 6, Article 1 of Circular 05/2017/TT-BNV. Thus, in the case of commune-level officials with intermediate vocational or college degrees, their salaries will be classified according to intermediate and college degrees as prescribed in Decree 92/2009/ND-CP (amended and supplemented in Decree 34/2019/ND-CP) and Circular 13/2019/TT-BNV.
What positions are included in commune-level cadres?
According to Article 4 of the Law on Cadres and Civil Servants 2008, commune, ward and town cadres (commune-level cadres) are Vietnamese citizens, elected to hold positions for a term in the Standing Committee of the People's Council, People's Committee, Secretary, Deputy Secretary of the Party Committee, head of a socio-political organization; commune-level civil servants are Vietnamese citizens recruited to hold a professional or technical position under the People's Committee at the commune level, on the payroll and receiving salaries from the state budget.
Article 61 of the Law on Cadres and Civil Servants specifically lists the following positions of commune-level cadres:
- Secretary, Deputy Secretary of the Party Committee;
- Chairman, Vice Chairman of People's Council;
- Chairman, Vice Chairman of People's Committee;
- Chairman of the Vietnam Fatherland Front Committee;
- Secretary of Ho Chi Minh Communist Youth Union;
- President of Vietnam Women's Union;
- Chairman of the Vietnam Farmers' Union (applicable to communes, wards and towns with agricultural, forestry, fishery and salt production activities and having the Vietnam Farmers' Union);
- President of Vietnam Veterans Association.
