Online conference to review and evaluate the implementation of Decree No. 21 of the Government

On the morning of October 24, the Ministry of Culture, Sports and Tourism held a conference to review and evaluate the implementation of Decree No. 21/2015/ND-CP, dated May 14, 2015 of the Government regulating royalties and remuneration for cinematographic, fine art, photographic, theatrical works and other performing arts.

The conference was held online to connecting points of provinces and cities across the country. In Ninh Binh , the conference was attended by leaders of the Department of Culture and Sports, leaders of a number of relevant agencies and units; representatives of leaders of specialized departments and offices under the Department; leaders of the Department of Culture and Information of districts and cities in the province.

The summary report on the implementation of Decree No. 21/2015/ND-CP was issued promptly, in line with the general development of society; contributing to concretizing and implementing well the Party and State's guidelines and policies on cultural and artistic activities in general and the royalty and remuneration regime in particular; creating a legal basis for paying royalties and remuneration for the creation, exploitation and use of cinematographic works, fine arts, photography, theater and other performing arts using the State budget or exploiting and using works whose copyright owner is the State.

Decree No. 21/2015/ND-CP clearly stipulates the subjects of application; payment principles, determination of royalties and remuneration; division of royalties and remuneration among co-authors and co-owners of copyright according to agreement; incentive royalties; royalties in cases where the work is used as a derivative work; budget preparation, payment and settlement; based on the genre, scale, quality of the work, art form, creative title, royalty and remuneration framework..., creating convenience in the implementation process, suitable to the practical situation.

The regulations on payment levels in Decree No. 21/2015/ND-CP facilitate agencies and units using the State budget in protecting estimates and clearing and settling expenses for annual royalties and remuneration; at the same time, it is the basis for building estimates and paying royalties and remuneration in the process of implementing annual tasks such as: performing for the people, building new art programs, participating in professional and mass art festivals; contributing to recognizing the artistic achievements of the creative team; at the same time significantly improving the regime and life of artists, supporting additional income for workers - the components participating in creating artistic works to serve the cultural and spiritual needs of the people.

At the conference, representatives of units such as; Department of Cinema; Department of Performing Arts; Department of Fine Arts, Photography and Exhibition; Vietnam Puppetry Theatre, Vietnam Circus Federation and representatives of a number of Departments of Culture, Sports and Tourism discussed and clarified the results of the implementation of Decree No. 21/2015/ND-CP in the past time, the shortcomings and limitations in the payment of royalties and remuneration depending on the budget of the units, and made proposals and recommendations to amend and perfect the legal regulations on the royalties and remuneration regime in Decree No. 21.

Thereby continuing to build, amend, supplement, perfect and well implement Decree 21, constantly improving the quality of artistic creation, meeting the art enjoyment needs of audiences and the public.
