On April 23, in Hanoi, the National Cyber Security Association (NCA) held a seminar on “Comments on the Draft Law on Personal Data Protection”. The draft law is expected to be submitted to the National Assembly for approval in May 2025 and take effect from January 2026.

At the seminar, Lieutenant General Nguyen Minh Chinh, Permanent Vice Chairman of the NCA, Director of the Department of Cyber Security and High-Tech Crime Prevention and Control (Ministry of Public Security) affirmed that the draft Law on Personal Data Protection is an important step forward in institutionalizing human rights and citizen rights, in line with the orientation of "taking people as the center, subject and goal of development" set forth in Resolution No. 27-NQ/TW (dated November 9, 2022) of the 13th Party Central Committee; linking personal data protection with human rights protection in the digital age.

In terms of legal basis, the law aims to create consistency in the national legal system, while also being consistent with international commitments that Vietnam has participated in. The overall goal is to complete a unified legal corridor, improve the capacity to protect personal data domestically, promote the development of the digital economy, ensure security, order and national data sovereignty. “More than 140 countries in the world have issued legal documents on personal data protection, most recently India, Thailand and Malaysia. Vietnam cannot delay any longer in issuing this law,” Lieutenant General Nguyen Minh Chinh emphasized.

The representative of the drafting committee, Major Dao Duc Trieu, Deputy Secretary General of the NCA, said that the draft law ensures harmony with international practices and regulations on personal data protection; socio-economic development, creating a legal foundation for business activities related to personal data; limiting and overcoming the situation of personal data being bought, sold, leaked, and lost widely, many violations of the law without handling regulations; helping to raise awareness and consciousness about personal data protection today...

At the seminar, representatives of the Institute for Policy Management and Development Strategy (Vietnam Union of Science and Technology Associations) made recommendations on improving the law on personal data protection from the perspective of international research and comparison; representatives of Viettel Group shared difficulties and proposed policy support for telecommunications enterprises in the process of implementing the law; Vietnam Data Security Company (VNDS) presented practical experience in complying with personal data protection requirements at technology enterprises.


Delegates agreed that personal data is an element closely linked to human rights, civil rights, and has a profound impact on cyber security, national security, and the entire digital ecosystem. Meanwhile, the current legal system on data protection is fragmented and lacks consistency. According to statistics, there are currently 69 legal documents referring to personal data, but only Decree 13/2023/ND-CP (dated April 17, 2023) is the first document to provide a relatively complete definition and principles of data protection. The development of the Law on Personal Data Protection on the basis of inheriting and developing from Decree 13/2023/ND-CP will create a more synchronous and complete legal foundation, overcome some shortcomings in state management of personal data protection, and raise awareness of personal data protection throughout society.
