Urgent request to monitor and inspect fake health food, milk and medicine

Market management forces inspect dairy products

In the urgent dispatch No. 2755/CD-BCT dated April 18, 2025 sent to the People's Committees of provinces and cities; the Department of Domestic Market Management and Development and the Department of Industry and Trade of provinces and cities, Minister Nguyen Hong Dien emphasized that in recent times, the Government , ministries and branches have issued many documents directing and urging on the prevention, combat and handling of acts of production and trading of counterfeit goods, banned goods, and goods of unknown origin.

Along with that are acts of infringement of intellectual property rights; acts of violation of laws on quality, measurement, food safety; acts of violation of laws on protection of consumer rights and acts of commercial fraud according to other legal provisions.

However, recently, the authorities have continuously inspected and discovered a number of businesses, organizations and individuals producing, advertising and distributing many types of fake milk, fake medicine and fake health food in some localities. It is noteworthy that the production and trade of these fake goods has lasted for many years, directly affecting the health and lives of the people.

In order to enhance the responsibility of relevant agencies in managing, supervising, promptly detecting, preventing and handling the production and trade of counterfeit goods, especially fake dairy products, fake medicines and fake health protection foods, the Minister of Industry and Trade, Deputy Head of the National Steering Committee 389, requested the People's Committees of provinces and cities to closely follow market developments, promptly synthesize and report to the Ministry of Industry and Trade on the fluctuations of the market of essential goods serving the needs of production, business and people's lives, especially those that directly affect people's health.

In addition, the authorities urgently reviewed and inspected the law enforcement of drug and health food businesses in the area, recalled counterfeit drugs and health food that were discovered, and strictly handled violations in accordance with regulations.

The Minister requested the People's Committees of provinces and cities to strengthen inspection and supervision of food security and safety; resolutely combat, prevent and strictly handle organizations, individuals, production and business establishments that violate food safety regulations. Promote the role of authorities at all levels, management agencies, social organizations and consumer supervision of compliance with food safety laws for individuals and food production and business establishments.

On the other hand, the Minister requested the People's Committees of provinces and cities to direct competent agencies under the provincial People's Committees to conduct post-inspection on self-declaration of products/registration of product declarations, production, trading, import, advertising, sampling and testing of products/product groups in Appendix II of Decree 15/2018/ND-CP dated February 2, 2018 of the Government.

In addition, develop a post-inspection plan for food production and trading establishments in the area, focusing on controlling food safety assurance, post-inspecting compliance with food safety regulations for establishments producing, trading, importing, and advertising health protection foods (on newspapers, radio, and the Internet); establishments producing and trading medical nutritional foods, foods for special diets; establishments producing, trading, importing, and advertising supplementary food products and nutritional formula products for young children.

On the other hand, direct relevant authorities to increase sampling to check the quality of goods for inspection teams in the localities; inspect and strictly handle acts of making false statements and advertisements, especially for products that directly affect people's health.

At the same time, the Minister also requested the People's Committees of provinces and cities to step up propaganda,education , raise awareness, identify responsibilities and actions of Party committees, Party organizations, cadres, Party members and people in ensuring food security and safety. Promote the role and responsibility of organizations, individuals and enterprises in enforcing food safety laws; promptly inform the supply chains of safe, high-quality agricultural products as well as establishments that violate and pose potential risks to food security and safety.

Regarding the Department of Domestic Market Management and Development, the Minister requested the Department to closely follow developments in the domestic market, closely coordinate with local authorities to ensure market stability and supply and demand of goods; direct market management forces to strengthen inspection and control, promptly detect, prevent and strictly handle acts of production and trading of fake food, fake milk and fake medicine.

For the Department of Industry and Trade of provinces and cities, the Ministry of Industry and Trade requests the Department of Industry and Trade to direct the local Market Management Department to focus on implementing the management of the area, regularly monitor and supervise the market. Thereby, in order to promptly detect unusual developments of goods circulating on the market, especially dairy products, medicines, health protection foods at small retail channels, unofficial agents, e-commerce platforms and social networks, where there are many potential risks of counterfeit goods, goods of unknown origin, and poor quality goods. In particular, proactively coordinate with local authorities to review and comprehensively inspect establishments producing and trading in dairy products, medicines, and health protection foods.
