ANTD.VN - The US Department of Commerce (DOC) has just announced its decision to extend the administrative processing deadline in the anti-dumping and anti-subsidy tax investigation procedure.

According to the Trade Remedies Authority (Ministry of Industry and Trade), the reason is that in fiscal year 2024 (from October 1, 2023 to September 30, 2024), DOC received 117 new petitions from domestic industries requesting the initiation of anti-dumping and/or countervailing duty investigations, exceeding the previous all-time high number of petitions filed in fiscal year 2020.
In just the first two months of fiscal year 2025 (which begins October 1, 2024), DOC received 25 additional petitions.
Accordingly, the deadline for issuing preliminary and final conclusions in administrative reviews and reviews of new exporters will be extended by a maximum of 90 days.
This decision applies to ongoing reviews that have an opportunity to request a review before 9 December 2024. At the same time, deadlines associated with the issuance of a preliminary or final conclusion in reviews will be adjusted accordingly to the extended deadline for issuing a preliminary or final conclusion (e.g. the deadline for submitting new factual information).
However, this decision does not apply to the deadlines for the parties to submit their responses, supplementary information, briefs and rebuttals. Individual requests for extensions will be considered on a case-by-case basis, provided that the request is submitted within the prescribed time limit;
