Support businesses to access and understand the law in production and business activities

(Chinhphu.vn) - On April 14, in Ho Chi Minh City, the Department of Legal Dissemination, Education and Legal Aid (Ministry of Justice) organized a dialogue conference on "Some issues to note according to the 2020 Enterprise Law, from a risk control perspective".

The conference was attended by legal experts, leaders of industry associations and nearly 100 small and medium enterprises in Ho Chi Minh City.

At the Conference, Ms. Ngo Quynh Hoa, Deputy Director of the Department of Legal Dissemination and Education, said that the Dialogue Conference focused on analyzing core and highly practical contents to support businesses in correctly and fully identifying legal requirements in current production and business activities.

The focus is on identifying the legal nature, rights and specific obligations of each type of enterprise such as private enterprise, limited liability company, joint stock company and partnership, thereby helping enterprises choose a model suitable for their development strategy and management capacity.

According to Ms. Ngo Quynh Hoa, small and medium enterprises currently account for the majority of Vietnamese enterprises. Besides their positive contributions to the economy, small and medium enterprises are also facing many challenges and limitations in accessing capital, accessing land, and accessing and understanding related laws and regulations.

Therefore, it is necessary to strengthen dialogue and exchange activities as well as support businesses to access and understand the law in their operations, thereby helping businesses operate in accordance with the law, effectively and develop more sustainably.

At the Conference, delegates discussed important innovations of the 2020 Enterprise Law in the management of business sectors and professions, especially the concretization of the principle "Enterprises are entitled to do business in what is not prohibited by law", while clarifying the legal boundaries for sectors and professions that are prohibited or restricted from investment and business according to the provisions of the Investment Law.

Through this, businesses are clearly oriented in establishing and implementing business areas, ensuring no violations of legal regulations and minimizing legal risks during operations.

At the same time, the Conference paid special attention to the role of the legal representative - the subject with a central position in the organization and operation of the enterprise. The discussion focused on clarifying legal responsibilities, information disclosure obligations, as well as legal limits in the representative authority of the legal representative, thereby helping enterprises strengthen internal governance mechanisms and build an effective risk control system, suitable for development requirements in the new period.

At the Conference, legal consultants also discussed and listened to feedback from the business community, discussed legal problems, difficulties and obstacles in the implementation process, and proposed solutions to remove them, creating a favorable environment for investment, production and business of enterprises.
