Gia Lai Provincial People's Committee is developing a plan to address the issues pointed out by the Government Inspectorate. In particular, the organization of land use rights auctions in Chu Se district was discovered by the Government Inspectorate to have many violations, causing a loss to the state of nearly 15.2 billion VND.
According to the Government Inspectorate, through a point inspection of the procedures for auctioning land use rights at 9 district-level units including Pleiku City, Ayun Pa Town, An Khe Town, Kbang District, Ia Grai, Duc Co, Chu Se, Dak Doa, Chu Prong, there were many shortcomings and violations such as: The approved auction plan did not estimate the value obtained and proposed the use of revenue from the auction results; there was no extract of the cadastral map or cadastral measurement of the land plot; organizing the auction of land use rights without issuing the Decision on auctioning land use rights.
The district-level People's Committee did not select an asset auction organization, signed a contract with an auction consulting organization when it was not assigned to organize the auction; did not organize the handover of land on the field to the winning households, and stipulated a deadline for paying land use fees that was not in accordance with regulations. The minutes of the land use rights auction were recorded incorrectly, did not clearly state the progress of the auction, and were not in the correct form....
Responsibility for the above-mentioned existence and shortcomings belongs to the People's Committee of Pleiku City and the districts, towns of Ayun Pa, An Khe, Kbang, Ia Grai, Duc Co, Dak Doa, Chu Se, Chu Prong (Chairman, Vice Chairman in charge, Head of the Department of Natural Resources and Environment) and related organizations and individuals over the periods.
Hundreds of land lots in the Administrative Center and Ecological Urban Area east of Chu Se town are owed auction winning money.
In addition to the above violations, a typical violation is the auction of land use rights in 2019 at the project of the administrative center planning area and the eastern ecological urban area of Chu Se town (Chu Se district).
In this project, Ms. Ho Thi Hien won the auction of 107 land lots (total amount of 83.4 billion VND), Mr. Nguyen Xuan Anh won 44 lots (30.1 billion VND), Mr. Le Viet Duc won 54 lots (39 billion VND). According to the auction plan, regulations on auctioning land use rights and decisions approving the auction results, within 15 days from the date of winning the auction, the winner must pay the entire auction amount.
However, Ms. Ho Thi Hien had a plot of land that was overdue for more than 20 days, and 61 plots of land that were overdue for 140 days or more; Mr. Nguyen Xuan Anh had 44 plots of land that were overdue for more than 300 days; and Mr. Le Viet Duc had 54 plots of land that were overdue for more than 100 days.
The Government Inspectorate determined that the District Land Fund Development and Auction Supervision Council and the Chu Se District People's Committee had lax management, lacked inspection, detected violations, and failed to cancel the auction results and recover the deposit (more than 15 billion VND) to the State budget.
In addition, the People's Committee of Chu Se district also allowed an extension of the time to pay the auction winning money, which is contrary to the provisions of the Auction Regulations and Auction Plan. At the time of the inspection, many plots of land had been transferred to other households and individuals.
The Government Inspectorate determined that the main responsibility for the individuals who were late in paying the auction winnings for land use rights belonged to Mr. Nguyen Hong Linh - former Chairman of the People's Committee of Chu Se district, currently Deputy Director of the Gia Lai Forest Protection and Development Fund; Mr. Nguyen Huu Tam, Vice Chairman of the People's Committee of Chu Se district; Head of the Chu Se - Chu Puh Tax Department and related departments.
