Recently, Vice Chairman of Hanoi People's Committee Nguyen Trong Dong signed a document on determining financial obligations for personal income tax and land revenues according to the provisions of the 2024 Land Law in the city.

Accordingly, the City People's Committee assigned the Department of Natural Resources and Environment to urgently review and advise the City People's Committee to issue a decision to adjust the land price list according to the provisions of the 2024 Land Law.

Notably, during the time when the decision to adjust the new land price list has not been issued, to resolve financial obligations and land tax records... the city accepts the principle of determining land prices as the basis for resolving financial obligations and land tax records according to the provisions of Clause 1, Article 159 of the 2024 Land Law.

Specifically, the land price in the land price list issued with Decision No. 30/2019, Decision No. 20/2023 amending, supplementing, and adjusting Decision No. 30/2019 is multiplied by the land price adjustment coefficient prescribed in Decision No. 45/2024 (for land rent), Decision No. 46/2024 (for land use fees and personal income tax) of the City People's Committee.

In case the transfer price stated in the real estate transfer contract, land use rights or tax declaration is higher than the land price according to the above determination principle, taxable income is determined according to the transfer price stated in the contract or tax declaration.

Land price list according to Decision 30/2019/QD-UBND of Hanoi People's Committee applies from January 1, 2020 to December 31, 2024. Currently, urban land on Hang Dao street (Hoan Kiem district) is the place with the highest price in Hanoi at 187.9 million VND/m2.

According to the land price list, the price will vary depending on each district, route, location, and type of land. In particular, plots of land in location 1 will usually have the highest price, because they are located off the road. Location 2 are alleys over 5m wide. Location 3 are alleys 3 - 5m wide. Location 4 are usually alleys under 3m wide. In the same area, the price will decrease in the order of the above locations.

In the near future, the current land price framework will be replaced by an annual land price list. With the goal of determining land prices according to market principles, experts say that the new price list will have land prices 10 times higher than the current price framework. Starting from January 1, 2026, this price list will be issued and updated by the People's Committees of the provinces once a year, instead of every 5 years as previously prescribed.
