Hanoi proposes minimum area of 50m2 to be able to subdivide plots
Hanoi is seeking opinions on a draft regulation on conditions for land division and consolidation, and the minimum area and size allowed for division for each type of land.
According to the Hanoi Department of Natural Resources and Environment, the draft closely follows Article 220 of the 2024 Land Law, which regulates land division and land consolidation.
According to the draft, if the land division does not form a new path, in wards and towns, the land plot must ensure a length of 4m or more, a width adjacent to the traffic road of 4m or more, and an area outside the red line of no less than 50m2.
In the plain communes, the minimum area is 80m2, in the midland communes, the minimum area is 100m2 and in the mountainous communes, the minimum area is 150m2.
In case of land division with the formation of a walkway, the walkway must have a cross-sectional width of 3.5m or more for towns, 4m or more for plain areas and 5m or more for midland and mountainous areas.
For non-agricultural land, this regulation applies to land plots other than those allocated or leased by the State for project implementation. In wards and towns, for commercial and service land, new land plots must have a width adjacent to traffic roads of 10m or more and an area of not less than 400m2. For other types of non-agricultural land, the width must be 20m or more and an area of not less than 1,000m2.
In other communes, for commercial and service land, the area is not less than 800m2 and for other non-agricultural land, the area is not less than 2,000m2.
The Department of Natural Resources and Environment said that land division must be carried out to ensure sustainable urban development and improve the quality of people's lives, balancing people's land use needs and the goal of developing a civilized and modern capital.
In addition to complying with the criteria on area and technical infrastructure, it is also necessary to carefully consider urban planning and living space.
In addition, the land division must ensure that it does not put pressure on the technical and social infrastructure system to avoid overload and ensure the quality of life in residential areas. In the long term, it is necessary to take into account sustainable development factors, avoid disrupting the general planning or causing imbalances in technical and social infrastructure, and maintain the cultural and historical values of the capital.
Currently, land division in Hanoi is applied according to Decision No. 20/2017. Accordingly, the land plot after division must have a minimum area of 30m2 for wards and towns and not less than 50% of the new land allocation limit (minimum) for the remaining areas.
Ho Chi Minh City collects 20,000 comments on adjusting land price list
On August 29, the Department of Natural Resources and Environment of Ho Chi Minh City provided information on the results of receiving comments at the conferences on land price adjustment.
Given the importance and impact of land price adjustment on organizations and individuals using land and the socio-economic situation in the area, the City has organized 4 additional conferences to collect opinions.
Specifically, on August 6, 2024, the Standing Committee of the Vietnam Fatherland Front Committee of Ho Chi Minh City held a conference to provide social feedback on the draft Decision to adjust Decision No. 02/2020/QD-UBND regulating land price lists in the City.
On August 13, 2024, the Department of Natural Resources and Environment coordinated with the City Party Committee's Mass Mobilization Committee to organize a Conference to introduce and exchange information on the issuance of the Decision to adjust Decision No. 02/2020/QD-UBND. On August 20, 2024, the City People's Council held a Conference to collect opinions from People's Council delegates on the adjustment of land price lists in the City.
From August 19 to 23, 2024, the City Party Committee's Propaganda Department conducted a survey and poll of public opinion on the Internet among cadres, party members, union members, and people living and working in the city to assess people's interest and suggestions related to the draft land price list expected to be applied in the city. As of the morning of August 21, 2024, more than 20,000 comments have been collected.
According to the synthesis data, the opinions focused on the common goal of building a suitable and realistic price list, with a roadmap, contributing to stabilizing and promoting the socio-economic development of the City, overcoming the shortcomings of the current price list, ensuring fairness in obligations, finance, and land in the area.
According to the provisions of the 2024 Land Law, the roadmap for adjusting the land price list includes 3 stages. Stage 1: From August 1, 2024 - December 31, 2025: Adjust the land price list to suit the actual situation of land prices in the City according to the provisions of Clause 1, Article 257 of the 2024 Land Law.
Phase 2: From January 1, 2026 to December 31, 2026. Currently, the Department of Natural Resources and Environment is carrying out procedures to submit to the competent authority for approval of the project implementation policy of the Land Price List to be applied for the first time from January 1, 2026 according to the provisions of Clause 3, Article 159 of the 2024 Land Law. The authority to approve the land price list in this phase belongs to the City People's Council.
Phase 3: From January 1, 2027 onwards. Adjust and amend the land price list to be announced and applied from January 1 of the following year.

Conditions for foreigners to rent houses
Point a, Clause 2, Article 21 of the 2023 Housing Law stipulates the obligations of home owners who are foreign organizations and individuals.
Accordingly, the following provisions are made:
a) For owners who are foreign individuals, they are allowed to rent out their houses for purposes not prohibited by law, but before renting out the house, the owner must notify in writing the housing management agency of the district, county, town, city under the province, city under the centrally-run city (hereinafter referred to as district level) where the house is located according to regulations of the Minister of Construction and must pay taxes on this housing rental activity according to regulations of law.
Article 3 of Circular No. 05/2024/TT-BXD detailing a number of articles of the Housing Law regulating the notification of housing lease by foreign individuals owning houses in Vietnam as follows:
1. Before signing a lease contract for a house owned by him/her, a foreign individual owning a house in Vietnam must send a written notice of the lease to the district-level housing management agency where the house is located. The content of the written notice includes the name of the owner, address of the house for rent, rental period, code number and date, month, year of issuance of the certificate of ownership of the house for rent, purpose of use of the house for rent, and a copy of the certificate of ownership of that house is attached.
2. Within a maximum period of 15 days from the date of termination of the housing lease contract, foreign individuals must send a written notice of termination of the housing lease contract to the district-level housing management agency where the rental housing is located for monitoring and management.
3. The district-level housing management agency is responsible for reporting to the provincial-level housing management agency periodically every 6 months, 1 year and upon request on the situation of housing rental by foreign individuals in the area for synthesis and reporting to the People's Committee of the province or centrally-run city (hereinafter referred to as the provincial-level People's Committee) and the Ministry of Construction.
Thus, foreigners renting houses need to carry out notification procedures according to the above regulations.
