How much is the fine for riding a motorbike on the sidewalk?
Sidewalks are an important part of the urban spatial structure. They are the transitional space between townhouses and streets and have a clear function. According to the law, sidewalks are part of urban roads, serving mainly pedestrians and combining them with the arrangement of urban technical infrastructure systems along the route.
According to Clause 1, Article 9 of the 2008 Road Traffic Law, traffic participants must drive on the right side of the road, in the correct lane and section of the road, and must comply with the road signal system.
In addition, according to Clause 3, Article 6 of Decree 100/2019, amended and supplemented by Decree 123/2021: Drivers of motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles driving on curbs and sidewalks will be fined from VND 400,000 to VND 600,000, except for the case of driving on the sidewalk to enter a house.
Meanwhile, for cars driving on the sidewalk, drivers will be fined from 4-6 million VND according to point d, clause 5, article 5 of Decree 100/2019 amended and supplemented in Decree 123/2021.
Thus, according to the above regulations, when participating in traffic, even during rush hour, motorcyclists are not allowed to drive on curbs or sidewalks, except in the case of driving across the sidewalk to enter a house.
What is the penalty for driving a motorbike in the wrong direction?
Clause 5, Article 6 of Decree No. 100/2019/ND-CP regulating administrative sanctions for violations in the field of road and railway traffic (Decree No. 100/2019/ND-CP) is amended and supplemented by Point c Clause 4 Article 2 of Decree 123/2021/ND-CP regulating sanctions for drivers of motorbikes, mopeds (including electric motorbikes), vehicles similar to motorbikes and vehicles similar to motorbikes violating road traffic rules as follows:
5. A fine of VND 1,000,000 to VND 2,000,000 shall be imposed on a driver who commits one of the following violations:
a) Driving in the wrong direction on a one-way street, driving in the wrong direction on a street with a "No entry" sign, except for violations specified in Point b, Clause 6 of this Article and cases where priority vehicles are on urgent missions as prescribed;
b) Not giving way or obstructing priority vehicles that are signaling priority while on duty.
Point b, Clause 10, Article 6 of Decree No. 100/2019/ND-CP stipulates penalties for drivers of motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles violating road traffic rules as follows:
10. In addition to being fined, the driver who commits the violation shall also be subject to the following additional penalties:
b) Committing the acts specified in Point b, Point e, Point i, Clause 3; Point e, Point g, Point h, Clause 4; Clause 5 of this Article shall have the right to use a driving license revoked from 01 month to 03 months;
Clause 4, Article 81 of Decree No. 100/2019/ND-CP stipulates the temporary revocation of the right to use a license or practice certificate or temporary suspension of operations in the field of road and railway traffic as follows:
4. During the period of revocation of the right to use a license or practice certificate, if an individual or organization continues to conduct the activities stated in the license or practice certificate, it will be punished as an act without a license or practice certificate.
Thus, driving a motorbike in the wrong direction can be fined from 1,000,000 VND to 2,000,000 VND and have the driver's license revoked for 01 to 03 months.
