Reducing administrative procedures in foreign labor management in Vietnam

At the training workshop on regulations on Work Permits for Foreigners under Decree 70/2023/ND-CP held on the afternoon of October 16, the leader of the Department of Employment (Ministry of Labor - Invalids and Social Affairs) said that by October 2023, there were 132,381 foreign workers working in Vietnam.

Of these, 10,458 workers are not subject to work permits and nearly 122,000 foreign workers are subject to permits.

According to local reports, the number of foreign workers working in foreign-invested enterprises accounts for over 72%, mainly concentrated in fields such as science and technology, manufacturing in electronics, services, education and training...

To remove difficulties and obstacles in carrying out administrative procedures related to licensing, the Ministry of Labor, War Invalids and Social Affairs has submitted to the Government for promulgation Decree No. 70/2023/ND-CP dated September 18, 2023 amending and supplementing a number of articles of Decree No. 152/2020/ND-CP dated December 30, 2020 of the Government regulating foreign workers working in Vietnam and recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam. The Decree takes effect from September 18.

Pointing out the new points of Decree 70, Deputy Director of the Department of Employment Nguyen Thi Quyen said that the decree has amended and supplemented a number of concepts such as foreign employees who are executives, experts, and technical workers are not required to have qualifications appropriate to the job position they are expected to work in Vietnam.

Regulations from January 1, 2024, the announcement of recruitment of Vietnamese workers for positions expected to recruit foreign workers shall be made on the Electronic Information Portal of the Ministry of Labor, War Invalids and Social Affairs (Department of Employment) or the Electronic Information Portal of the Employment Service Center established by the Chairman of the People's Committee of the province or centrally-run city within at least 15 days from the expected date of reporting the explanation of the need to use foreign workers.

Regarding re-issuance of work permits, supplement cases eligible for re-issuance of work permits and related documents in the application for re-issuance of work permits.

Within 3 working days from the date the foreign employee starts working, the employer must report electronically to the Ministry of Labor, War Invalids and Social Affairs and the Department of Labor, War Invalids and Social Affairs where the foreign employee comes to work.

The Decree stipulates a single focal point, the Department of Labor, War Invalids and Social Affairs, in approving the need to use foreign labor, granting, re-granting, extending, revoking work permits and certifying foreign workers in the locality.

At the workshop, many units also raised specific questions related to foreign labor management in Vietnam and were directly answered by leaders of the Department of Employment.

Director of the Department of Employment Vu Trong Binh said that the management of foreign labor is of great concern to Vietnam. The Government's Resolution on labor market development has identified foreign labor as an inseparable part of the Vietnamese labor market.

"In terms of labor force and human resource development, there is no distinction between Vietnamese and foreign workers working here. In the process of developing legal documents, depending on each period, there will be a balance and complement between these two labor forces," said Mr. Binh.

According to the Director of the Department of Employment, for Decree 70, all administrative procedures are minimized as much as possible. The drafting agency has discussed very carefully about reducing procedures, creating favorable conditions for businesses and ensuring compliance with legal regulations.

In addition to all the simplified administrative procedures, the Decree for the first time includes a process for granting foreign workers permits to work in multiple locations. This time, with a single permit, stating the location, foreigners can work anywhere in Vietnam.

Mr. Binh assessed that the Decree fundamentally innovates the management of foreign workers working in Vietnam. All foreign worker management is unified at the Department of Labor, War Invalids and Social Affairs.
