The amended Trade Union Law maintains the 2% trade union fee contribution rate while adding the right of trade unions to monitor and provide social feedback.
This morning (November 27), with a majority of delegates voting in favor, the National Assembly passed the amended Trade Union Law, which retains the current regulation on the 2% trade union fee. Presenting a summary report on the acceptance, explanation, and revision of the draft amended Trade Union Law, Ms. Nguyen Thuy Anh, Chairwoman of the National Assembly's Social Committee, stated that one of the fundamental new points of the amended Trade Union Law is the maintenance of the 2% trade union fee contribution rate. In addition, the law amends and supplements regulations to clarify the principles of managing and using trade union finances; amends and supplements the expenditure tasks of trade union finances; adds a regulation for the Vietnam General Confederation of Labor to implement the decentralization of collecting and distributing trade union funds; and stipulates that the Vietnam General Confederation of Labor shall issue standards, norms, expenditure regimes, and management and use of trade union finances after consultation with the Government.

The law also adds cases of exemption, reduction, and temporary suspension of trade union fees, and the Government will regulate these cases after consultation with the Vietnam General Confederation of Labor. Ms. Nguyen Thuy Anh, Chairwoman of the National Assembly's Social Affairs Committee, stated that the exemption, reduction, and temporary suspension of trade union fees directly impacts the balance of trade union finances, ensuring the necessary resources for the entire trade union system and the distribution of funds by the Vietnam General Confederation of Labor. Therefore, in response to the opinions of delegates, and to ensure consistency with the tasks and practical activities of the Trade Union and the proposals of the drafting agency, the National Assembly Standing Committee directed a review to ensure uniformity in the subjects eligible for exemption, reduction, and temporary suspension of trade union fees, adding the provision "The Government will consult with the Vietnam General Confederation of Labor" when regulating the exemption, reduction, and temporary suspension of trade union fees in Article 30 of the draft Law. The draft Law on Trade Unions (amended) that was passed consists of 6 chapters with 37 articles, an increase of 4 articles compared to the current Law. The Law will take effect from July 1, 2025.
Speaking to reporters immediately after the amended Trade Union Law was passed by the National Assembly, Mr. Tran Van Hieu, Chairman of the Trade Union of Industrial Zones in Bac Ninh province, expressed his hope that maintaining the 2% trade union fee would help trade unions better care for workers. However, according to him, stronger sanctions are needed against units that owe trade union fees and social insurance contributions for their employees; and that these debts must be collected correctly and fully from businesses that are still in arrears.
