As reported, on the afternoon of June 14, Quynh Luu District Police (Nghe An Province) announced that they had decided to fine Mr. TVC (born in 1993, residing in Quynh Thanh Commune, Quynh Luu District) 7.5 million VND for posting false information about the incident in Dak Lak.
Mr. TVC admitted that he had posted untrue and unverified content on his personal account, which had damaged the reputation of the local government and the police force. After working with the police, Mr. TVC removed the post and posted a correction.
In another development, Ho Chi Minh City Police have just administratively fined Mr. NHAD (56 years old, residing in Binh Hung commune, Binh Chanh district) 7.5 million VND for posting false information about the incident in which a group of people attacked the headquarters of the People's Committee of a commune in Dak Lak province.
The authorities determined that Mr. D's behavior violated Point d, Clause 1, Article 101, Decree No. 15/2020/ND-CP dated February 3, 2020 of the Government stipulating administrative sanctions for violations in the fields of post and telecommunications, radio frequencies, information technology and electronic transactions (amended and supplemented in Decree No. 14/2022/ND-CP).
The police have advised people to absolutely not post or share false, unverified information on social networks, causing public panic and affecting security and order.
Posting false information on social networks that causes public confusion will be handled according to the law. If the posting causes serious impacts or consequences, it may result in criminal prosecution.
However, similar incidents have occurred in many places. On June 16, VNA reported that Dak Lak Provincial Police coordinated with the police of districts, towns and cities to detect and handle more than 100 cases of posting bad and toxic information related to the incident of a group of people attacking the headquarters of the People's Committee of a commune in the province.
The violations mainly involved re-sharing information from Facebook pages, Tiktok... of individuals for the purpose of interacting on social networks. After being explained, the cases realized their wrongdoings, removed the posts themselves and wrote a commitment not to repeat the offense.
Illegal behavior
Speaking with VietNamNet, Dr. and lawyer Dang Van Cuong analyzed: The act of posting fabricated and distorted information on cyberspace is a violation of the law, and those who commit this act may be subject to administrative sanctions or criminal prosecution.
When posting information on cyberspace, the person providing and sharing information must be responsible for the content of the information, must comply with the provisions of the law on ensuring network security and safety, and must not violate the prohibitions of the law on information and communication and network security.
The lawyer said that Articles 8, 16 and 17 of the Law on Cyber Security stipulate that it is prohibited to use cyberspace to perform the following acts:
Propaganda distorting and defaming the people's government; Psychological warfare, inciting wars of aggression, division, causing hatred between ethnic groups, religions and peoples of countries; Insulting the nation, national flag, national emblem, national anthem, great people, leaders, celebrities, and national heroes.
It is strictly forbidden to post information on cyberspace that incites riots, disrupts security, and disturbs public order, including: Calling for, mobilizing, inciting, threatening, causing division, conducting armed activities or using violence against the people's government; Calling for, mobilizing, inciting, threatening, and enticing crowds to gather to cause trouble, resist law enforcement officers, obstruct the activities of agencies and organizations, causing instability in security and order, etc.
Depending on the nature and severity of the violation and the consequences, the violator will be subject to administrative sanctions or criminal prosecution.
In cases where the act of providing false information has not caused serious consequences, the person committing this act may be subject to an administrative penalty of 5-10 million VND for individuals and 10-20 million VND for organizations.
