Social housing for rent at 4.5-8 million VND/month

According to the law, social housing cannot be bought, sold, transferred or rented within 5 years from the date of full payment of the purchase or rental. However, in reality, there are many cases where the purchase or rental contract is not yet dry and is then rented out.

According to the PP account owner, the apartments that the landlord "sends" for rent and resale are often not in demand and are 100% new. Some apartments have been fully furnished by the landlord, and the tenant only needs to bring their suitcase and move in. Some apartments are still in a raw state, and the tenant must invest in the furniture themselves. The tenant signs a contract directly with the landlord, and the broker only receives a commission.

Ms. Hang, an employee of a company in Bien Hoa city, shared that her family is low-income and has struggled to get a social housing quota. Meanwhile, some people buy social housing and then rent it out to make a profit.

Ms. Hang suggested that it is necessary to be stricter in reviewing applications, ensuring transparency and fairness, avoiding those who have the means to take over places from those who really need them.

According to Deputy Director of Dong Nai Housing Trading Joint Stock Company Nguyen Nam Thanh (investor), the company has issued warnings and recommendations to buyers and renters of houses at the A6-A7 Social Housing Project.

The content of the warning information is that the apartment management board has recorded that a number of individuals and organizations have contacted residents to broker, buy, sell, and rent social housing apartments. To ensure compliance with legal regulations and avoid unnecessary risks, the apartment management board recommends not to conduct illegal transactions of buying, selling, or renting social housing apartments. Illegal transfers and rentals may result in contract cancellation, apartment repossession, and legal action.

At the same time, be wary of illegal brokers; do not provide personal information, housing documents or engage in transactions with unclear individuals or organizations. Only transact in accordance with legal regulations; all transactions related to social housing apartments must comply with prescribed procedures and be carried out through competent authorities.

Suggest to return the house if no need to stay

The 2023 Housing Law and its guiding documents stipulate that social housing cannot be transferred within 5 years. In cases where the above time has not passed and the buyer or lessee of social housing no longer has a need to live there, the property can only be transferred to two entities: the investor of that social housing project or an entity eligible to buy social housing.

If the above two subjects intentionally buy and sell social housing before the 5-year period, the purchase, transfer, or lease contract will be invalid. The buyer is forced to hand over the social housing to the management unit. In case of intentional non-handover, the provincial People's Committee will enforce the repossession of the housing.

Regarding the information about the above-mentioned social housing for sale and lease, Deputy Director of the Department of Construction Huynh Tan Loc said that on April 11, the department issued an official dispatch on establishing an inspection team for social housing projects that have been put into use in Bien Hoa city. The inspection time is after April 17.

The purpose is to rectify the management and use of social housing in the province in general and Bien Hoa city in particular, ensuring the right purpose and right target.

The Department of Construction requests that those who have purchased, rented, or leased-purchased social housing in Bien Hoa City, if they no longer have a need to use it, contact the investor or project manager to return the housing. In case the housing is not returned voluntarily, the Department will conduct an inspection and handle it according to the provisions of law.

Decree 16/2022/ND-CP dated January 18, 2022 of the Government stipulates that in case of intentionally advertising for sale social housing that does not meet the conditions, a fine of 40-60 million VND will be imposed when selling, leasing, or leasing-purchasing social housing to the wrong subjects or failing to ensure the conditions prescribed by the Housing Law. A fine of 100-120 million VND will be imposed when the lessee, lessee-purchaser, or buyer of social housing sells, subleases/lends the house in violation of regulations. The social housing must be recovered or the money must be refunded to the buyer or lessee. These fines apply to organizations, while for individuals, the fine is half that of an organization.
