In this report, the province pointed out many problems that could lead to a shortage of construction materials for projects, the biggest of which is land.

Have land but not rented yet
According to the province's report, in the past, the exploitable land area at mines was much lower than the licensed land area because enterprises had difficulty in negotiating the transfer of land use rights, then had to change the land use purpose to lease land and exploit. Just counting the transfer of land use rights, many cases could not be transferred immediately; many areas of land had been agreed upon but were stuck in procedures such as: land had not been granted a certificate of land use rights, the land transferor had died, moved to another place or had not completed inheritance procedures for transfer; the land received for transfer had expired... and had not completed land lease procedures.
Typical of the above problems are 10 quarries in the Tam Phuoc - Phuoc Tan quarry cluster, Bien Hoa city. All quarries have been granted mineral exploitation licenses, have paid the right to exploit, 9/10 quarries have been leased land in part of the licensed area. The land area used by enterprises for exploitation has been transferred or compensated to land users.
Recently, the Provincial People's Committee has directed and directly resolved the issue of extending mineral exploitation licenses, adjusting and supplementing investment certificates, adjusting zoning plans, approving land use plans... However, overcoming existing problems to resolve land lease procedures requires a certain amount of time.
In case the mines have to stop operating in the area where they have not leased land, the mining and processing output will decrease significantly. Specifically, 10 mines in the Tam Phuoc - Phuoc Tan mining cluster have only 1.89 million m³ left, not enough to meet the demand of 6.4 million m³ to serve 3 projects: Long Thanh International Airport, Bien Hoa - Vung Tau Expressway, Ho Chi Minh City Ring Road 3. Meanwhile, the progress of supplying for the key traffic project in the South is very urgent, needing to be completed in 2025.

Allow legal completion before 31-12-2025
From the above problems, the Provincial People's Committee proposed that the Ministry of Agriculture and Environment agree to allow enterprises to continue mining, production and business activities on land areas that have been granted mining licenses, have completed compensation and site clearance work, and are currently mining and processing construction stone but have not completed land lease procedures from now until December 31, 2025. Products exploited in these areas that have not been leased land are only to serve key traffic projects and works in the South.
During the permitted exploitation period from now until December 31, 2025, the Department of Agriculture and Environment will support enterprises in removing difficulties and obstacles in land procedures to lease land and operate in accordance with the law; complete the handling of administrative violations and require enterprises to pay land use rights, taxes, fees; land rent and other fees in accordance with the law.
Recently, investors and contractors of key projects have made statistics on the demand for construction materials needed in 2025. Based on that, the Provincial People's Committee has issued a document allocating the volume for each mine and each project. However, due to legal problems regarding land, investment in mineral mines is limited in exploitation capacity, so the source of materials brought to the construction site is not as expected.
