Accordingly, Circular 01/2024/TT-BKHĐT consists of 4 chapters, 32 articles with 23 sample documents and attached appendices, inheriting previous regulations and supplementing and updating new regulations according to the Bidding Law 2023, contributing to ensuring consistency and uniformity in the implementation of legal regulations on bidding as well as the progress of implementing bidding packages and projects, avoiding shortages of medical supplies and equipment and ensuring the progress of disbursement of public investment capital.
The Ministry of Planning and Investment said that this circular continues to simplify procedures and cut costs in contractor selection activities; create favorable conditions to encourage bidding parties and contractors to participate in the National Bidding Network System, enhancing competitiveness in the public procurement market. At the same time, it completes the processes, procedures and technical features of the National Bidding Network System to improve feasibility, transparency and consistency in online contractor selection activities.
Issued with the Circular are 3 forms for preparing, appraising and approving the overall contractor selection plan, including: Form No. 01A is used to prepare the submission for the overall contractor selection plan; Form No. 01B is used to prepare the appraisal report for the overall contractor selection plan; Form No. 01C is used to prepare the decision approving the overall contractor selection plan. In addition, there are 3 forms for preparing, appraising and approving the contractor selection plan, including: Form No. 02A is used to prepare the submission for the contractor selection plan; Form No. 02B is used to prepare the appraisal report for the contractor selection plan; Form No. 02C is used to prepare the decision approving the contractor selection plan.
For construction bidding packages, there are 3 forms issued with the Circular, including: form No. 3A to prepare E-HSMT applying the form of open bidding, restricted bidding, competitive bidding in the form of one-stage, one-envelope method; form No. 3B to prepare E-HSMT applying the form of open bidding, restricted bidding in the form of one-stage, two-envelope method; form No. 3C to prepare E-HSMST (pre-qualification invitation documents).
For goods procurement packages (including centralized procurement cases), there are 3 forms issued with the Circular, including: Form No. 4A to prepare E-HSMT applying the form of open bidding, restricted bidding, competitive bidding in the form of one-stage, one-envelope method; Form No. 4B to prepare E-HSMT applying the form of open bidding, restricted bidding in the form of one-stage, two-envelope method; Form No. 4C to prepare E-HSMST.
Article 25 of Circular 01/2024/TT-BKHĐT clearly states the contractor's responsibility for the accuracy of the information declared on the webform and attached documents during the bidding process. For similar contracts, production capacity, the contractor declares and attaches related documents to prove the declared information. For requirements on financial resources, the contractor declares information; in case the contractor uses a credit commitment to prove financial resources, in addition to declaring information, the contractor attaches a scan of the credit commitment.
The Circular also stipulates that the Bidding Newspaper is responsible for reviewing and detecting invalid information and notifying the investor and the bidding party within a maximum of 1 working day from the time the investor and the bidding party self-post the information on the System. The notification is made on the System, email, mobile application or other information channels about the invalid information content so that the investor and the bidding party can self-edit, complete and re-post on the System.
According to the Ministry of Planning and Investment, Circular 01/2024/TT-BKHĐT stipulates retroactive effect for the contents on providing and posting information on contractor selection and bidding document templates, effective from January 1, 2024.
From January 1, 2024, Circular No. 08/2022/TT-BKHĐT dated May 31, 2022 of the Minister of Planning and Investment detailing the provision and posting of information on bidding and contractor selection on the National Bidding Network and Circular No. 10/2015/TT-BKHĐT dated October 26, 2015 of the Minister of Planning and Investment detailing the contractor selection plan will cease to be effective.
