The investment project to upgrade Than Nong canal (section from Cai Tac canal to Cau Doi bridge) in Phu Hung and Phu Xuan communes was implemented since 2002 according to Decision 2317/QD.CT.UB, dated September 30, 2002 of the Provincial People's Committee Chairman on land recovery and allocation; Decision 2495/QD-CTUB, dated October 23, 2002 on approval of compensation plan; Decree 22/1998/ND-CP, dated April 24, 1998 of the Government on compensation for damages when the State recovers land for national defense - security purposes, national interests, and public interests.
This project has 78 households whose land is recovered, 59 households whose houses and structures are demolished. Mr. Duong Van Tam's household had 431.5m2 of land, 40.5m2 of house, structures (roof, kitchen, skylight), electric meter and crops recovered. On December 3, 2002, Phu Tan District People's Committee issued Decision 71/QD-UB on compensation for damaged assets of the project. The support policies for Mr. Tam's household are more than 48 million VND. Mr. Tam received the money, demolished his house, and rebuilt a new house on the remaining land behind his family.
However, Mr. Tam later complained, requesting an increase in the compensation price for the house and land. On April 8, 2003, the Chairman of the People's Committee of Phu Tan district issued Decision 08/QD.UB.KN, maintaining Decision 71/QD.UB. Ms. Ne complained to the province, requesting an increase in the compensation price for the house and land. On August 24, 2004, the Chairman of the People's Committee of the province issued Decision 417/QD-UB-KN, maintaining Decision 08/QD.UB.KN; rejecting the complaint request of Mr. Tam and Ms. Ne.
For many years, Ms. Ne continuously complained that her family's house and land did not belong to the Than Nong canal upgrade project (2002), but to the Bac Vam Nao flood control project (2005), requesting an increase in compensation prices for the house and land. The Provincial People's Committee and central agencies have inspected, received, and explained that her complaint had no basis for consideration and resolution. Specifically, on January 13, 2006 and March 24, 2006, the Chairman of the Provincial People's Committee received Ms. Ne and concluded: Her family's house and land belonged to the Than Nong canal upgrade and renovation investment project, not the Bac Vam Nao project. The resolution of the Provincial People's Committee Chairman was in accordance with the law; the resolution was to sell Ms. Ne's family a house plot in a flood-proof residential area at a flexible price, reduced by 10 - 20%.
Ms. Ne did not agree and requested to increase the compensation price for the house and land. In Minute 01/BB-DCT, dated July 12, 2006, the Government Inspectorate Working Group (according to Document 947/CV-TTCP, dated May 18, 2006 of the Government Inspector General) coordinated with the Provincial People's Committee to inspect and review Ms. Ne's complaint and concluded: Agreed to resolve the complaint of the Provincial People's Committee. On December 7, 2006, the Chairman of the Provincial People's Committee received Ms. Ne and affirmed that her request to increase the compensation price for the house and land was not grounded for re-consideration.
The People's Committee reported the results of Ms. Ne's complaint to the Government Inspectorate, the Central Party and State Citizen Reception Office in Hanoi, and the Southern Central Party and State Citizen Reception Office. At the same time, the People's Committee responded to Ms. Ne that her complaint had no new details; had been checked, reviewed, and explained many times, and the province and the Government Inspectorate agreed not to resolve anything further. Therefore, on March 8, 2016, the Provincial People's Committee issued Notice 111/TB-UBND to terminate the settlement of this household's complaint.
Ms. Ne continued to complain. The Provincial People's Committee worked with the Government Inspectorate and agreed on a solution to maintain Decision 417/QD-UB-KN; sell Mr. Tam and Ms. Ne a house plot at a 20% discount, on the condition that she stops complaining. If she does not agree, the Chairman of the Provincial People's Committee will issue a document to terminate the complaint settlement. Ms. Ne's complaint and request for compensation for the house and land under the Bac Vam Nao project and Decree 197/2004/ND-CP is not a basis for settlement. Decision 417/QD-UB-KN has been resolved in accordance with the law, according to the content agreed with the Government Inspectorate.
At the dialogue on April 15, 2025, local leaders, departments, branches, and the Provincial Inspectorate encouraged and explained land law regulations through the periods, ensuring that the process of resolving citizens' complaints is in accordance with legal regulations. Concluding the dialogue, Alternate Member of the Party Central Committee, Deputy Secretary of the Provincial Party Committee, Chairman of the An Giang Provincial People's Committee Ho Van Mung affirmed that Ms. Ne's complaint had no new details. She could not provide documents related to her compensation land under the Bac Vam Nao project, so there was no basis for resolution.
The Chairman of the Provincial People's Committee requested the Provincial Inspectorate to continue reviewing the settlement procedures, ensuring compliance with the law; Phu Tan District People's Committee reviewed and re-examined the land for compensation of Ms. Ne to see if it belongs to the project to upgrade and expand Than Nong Canal. The Department of Agriculture and Environment reviewed the land that Phu Tan District People's Committee decided to recover (in Mr. Tam's name) to see if it belongs to the Bac Vam Nao project. Requested the 2 units to inspect and respond in writing before May 15, 2025. Regarding the conclusion of the Government Inspectorate on supporting the sale of land at a 20% discount for Ms. Ne, Chairman of An Giang Provincial People's Committee Ho Van Mung assigned the relevant agencies to advise on the implementation of this content, if Ms. Ne agrees to end the complaint.
