Enterprises discharging emissions must declare and pay environmental protection fees.

A new legal provision that will be applied at the beginning of 2025 is Decree No. 153/2024/ND-CP dated November 21, 2024 of the Government (effective from January 5, 2025), establishments that discharge emissions (dust, industrial emissions) into the environment must declare and pay environmental protection fees. To implement the above regulation, the City People's Committee has just assigned the Department of Natural Resources and Environment to organize the collection of environmental protection fees for establishments discharging emissions in the city.

Decree No. 153/2024/ND-CP of the Government stipulates the subjects of fees and fee payers; fee collection organizations; fee calculation methods, fee collection levels, declaration, declaration appraisal and fee payment; management and use of environmental protection fees for emissions. Emission-emitting facilities are identified as establishments producing cast iron, steel, metallurgy (except rolling, drawing, casting from raw material ingots); producing basic inorganic chemicals (except industrial gases), inorganic fertilizers and nitrogen compounds (except mixing, decanting, packaging), chemical pesticides (except mixing, decanting); refining, petrochemicals; recycling, treatment of domestic solid waste (garbage), ordinary industrial solid waste, hazardous waste; using imported scrap from foreign countries as production materials; producing coke, producing coal gas; Cement production... and other production, business and service establishments that generate dust and industrial emissions.

The environmental protection fee for facilities discharging emissions that are not subject to fixed emission monitoring is 3 million VND/year (750,000 VND/quarter). For facilities discharging emissions that are subject to emission monitoring, in addition to the fixed fee of 3 million VND/year (750,000 VND/quarter), they are also subject to variable fees for environmental pollutants in the emissions. The basis for determining the fee is the results of emission monitoring (automatic, continuous or periodic), environmental technical regulations on emissions, etc.

Implementing the provisions of Decree No. 153/2024/ND-CP, the City People's Committee has just issued Official Dispatch No. 666/UBND-STNMT dated February 5, 2025 assigning the Department of Natural Resources and Environment to organize the collection of environmental protection fees for facilities discharging emissions in the city under the environmental licensing authority of the Ministry of Natural Resources and Environment and the City People's Committee according to regulations.

The Department of Natural Resources and Environment has sent a document requesting that facilities discharging emissions subject to environmental protection fees under the provisions of Decree No. 153/2024/ND-CP and under the authority of the Ministry of Natural Resources and Environment to issue environmental licenses, and the People's Committee of Da Nang City, prepare and submit declarations for payment of environmental protection fees. At the same time, the Management Board of Da Nang High-Tech Park and Industrial Zones is requested to coordinate in notifying facilities discharging emissions in industrial parks, Da Nang High-Tech Park, and Concentrated Information Technology Parks under its management authority to declare and pay environmental protection fees...

Deputy Director of the Department of Natural Resources and Environment Dang Quang Vinh said that facilities that discharge emissions must declare and pay environmental protection fees, which is a new legal provision and will start paying fees from 2025.

The requirement for establishments that discharge emissions to declare and pay environmental protection fees is a solution that contributes to reducing dust and industrial emissions. Previously, the Department of Natural Resources and Environment also sent an official dispatch to 31 establishments that emit large amounts of greenhouse gases in the city to urge them to conduct greenhouse gas inventories; develop and submit greenhouse gas inventory reports of the establishments to the city before March 31, 2025 as prescribed.

The Department of Natural Resources and Environment also requested the Department of Industry and Trade, the Department of Transport, the Department of Construction, the Management Board of the High-Tech Park and Industrial Parks of Da Nang to coordinate in reviewing and updating greenhouse gas emission facilities that must conduct greenhouse gas inventories according to the provisions of Decree No. 06/2022/ND-CP of the Government and send them to the Department of Natural Resources and Environment for synthesis, consulting the City People's Committee to send to the Ministry of Natural Resources and Environment and related ministries.

Greenhouse gas inventories are carried out to determine the level of greenhouse gas emissions and absorption, thereby having plans and solutions to control and reduce greenhouse gas emissions, aiming for carbon neutrality, minimizing environmental pollution, contributing to the implementation of Vietnam's commitment to reduce net emissions to "0" (Net Zero) by 2050.
