Enterprises have not agreed on a relocation plan, Binh Dinh has set up a separate working group to resolve the issue.

Regarding the fact that Vu Ha Company has not yet agreed on a plan to support the cost of relocating the nursery due to the impact of the highway project, Binh Dinh province has set up a separate working group to resolve the issue.

Set up a separate working group

To resolve the difficulties in compensation and site clearance for Vu Ha Company Limited under the North-South Expressway Project in the Eastern Region for the period 2021-2025, through Tuy Phuoc district, Mr. Nguyen Tu Cong Hoang, Vice Chairman of Binh Dinh Provincial People's Committee, has just signed a decision to establish a Working Group to guide compensation and support site clearance for Vu Ha Company Limited affected by the Project.

The working group is headed by Mr. Tran Ky Quang, Deputy Director of the Department of Natural Resources and Environment of Binh Dinh province. This group is responsible for guiding and compensating for the site clearance for Vu Ha Company Limited affected by the expressway project; promptly advising and proposing to the Provincial People's Committee to consider and resolve problems in compensation and support for the Company.

The North-South Expressway construction project in the East phase 2021-2025, through Binh Dinh province, as of April 2, 2024, the localities have basically completed and handed over the site to the investor with an area of ​​951/953.19 hectares, reaching 99.8%; length 117.57/117.99 km, reaching 99.6%.

However, in addition to 53 cases of households that have received compensation and resettlement land but have not yet handed over the site; Binh Dinh has only 2 organizations, Viettel Binh Dinh Construction Branch (in Hoai Nhon town, relocating the rooftop solar power project) and Vu Ha Company Limited (in Tuy Phuoc district) that have not yet agreed on a compensation plan.

In Notice No. 135, dated April 4, 2024, along with assigning the Department of Natural Resources and Environment to propose the establishment of the above-mentioned working group, Mr. Nguyen Tu Cong Hoang, Vice Chairman of Binh Dinh Provincial People's Committee assigned Tuy Phuoc District People's Committee to organize a meeting with Vu Ha Company Limited to soon agree on a compensation plan, support site clearance, and complete the approval of the compensation plan before April 15, 2024.

The Vice Chairman of Binh Dinh Provincial People's Committee requested that the relocation be completed before April 30, 2024. If the unit does not comply, complete the documents and procedures to implement the enforcement plan in accordance with regulations.

Why businesses do not agree

According to the report of Tuy Phuoc District People's Committee, Vu Ha Company Limited had its land recovered with an area of ​​16,330.6 m2, other agricultural land (NKH) along with affected assets on the land including houses, structures and crops (of which the high-tech tissue culture house affected is 400 m2).

According to Decision No. 12281, dated December 19, 2023 of the Chairman of Tuy Phuoc District People's Committee, the total value of compensation and support approved in the first phase for Vu Ha Company Limited is more than 6.26 billion VND; including investment costs in land, tissue culture house, including electricity and water in the house but not including the electricity system and irrigation pipes outside (calculated in the second phase).

Vu Ha Company Limited has received the money according to the above approval decision and committed to clean up and hand over the areas outside the scope of the tissue culture house.

In the second phase, Tuy Phuoc District People's Committee only calculated support for the domestic electricity system for irrigation, the water pipe system for irrigation and the relocation of assets in the tissue culture house (according to the price quotation of the valuation company) with a total amount of more than 2.1 billion VND.

On February 20, 2024, the Project Compensation and Site Clearance Council announced the above value to Vu Ha Company Limited, but the Company has not agreed to continue the petition.

The petition of this Company mentioned that the North-South Expressway passing through the nursery of Vu Ha Company Limited has seriously affected the Company's assets and spirit, it directly affects the existence and development of the enterprise.

Therefore, Vu Ha Company Limited requested Tuy Phuoc District People's Committee to provide specific support for 7 categories, totaling more than 19.43 billion VND. However, Tuy Phuoc District People's Committee stated that Vu Ha Company Limited's support requests were unfounded.

In which, Vu Ha Company Limited proposed to support the relocation and loss of rooting and rooting seedlings of 40% equivalent to the amount of more than 17.14 billion VND (value provided by the company).

Regarding this content, according to Tuy Phuoc District People's Committee, the Project's Compensation and Site Clearance Council hired a price appraisal unit to quote a 3% loss in transporting the plant pots, but through information, Vu Ha Company Limited did not agree and still requested support for relocation and a 40% loss in rooting and rooting pots.

Tuy Phuoc District People's Committee said that there was not enough basis to answer the Company and this matter was beyond its authority; therefore, the District People's Committee reported to the Provincial People's Committee for consideration of the policy of calculating the cost of loss and damage to materials during the process of dismantling, transporting and installing at 20% of the new value according to Clause 2, Article 25 of Decision No. 04, dated February 14, 2019 of Binh Dinh Provincial People's Committee.
