According to the report of the Chemical Corps, clearly aware of the role and tasks in emergency situations, in the past time, the unit has thoroughly grasped and strictly implemented the Ordinance on State of Emergency and legal documents with provisions on state of emergency, such as: Law on National Security, Law on Atomic Energy; Law on Prevention and Control of Infectious Diseases; Law on Prevention and Control of Natural Disasters; Law on National Defense; Law on Civil Defense, etc.

During the implementation of the mission, the Corps has performed well its advisory function to the Prime Minister and the Head of the Ministry of National Defense to issue many documents on strategic policies and measures in the fields of chemistry, biology, radioactivity and nuclear (CBRN) and the environment. It has also advised the Government and the Ministry of National Defense on many policies, measures, mechanisms for directing and operating, and plans for organizing and using forces in responding to and overcoming incidents of toxic chemicals, radiation, the environment and the Covid-19 pandemic; advised on investment, installation, and putting into service units the Radiation Reconnaissance System in the army...
Based on the assigned functions and tasks, the Corps has proactively advised and proposed to the Central Military Commission and the Ministry of National Defense to deploy projects and programs to improve the capacity to perform tasks. Directing agencies and units to organize specialized training in rescue for subjects in accordance with regulations; in which, focusing on training to improve command and management capacity, specialized training, close to reality; specialized training combined with physical training for soldiers...

Working scene
From the fact that the implementation of the task still has some limitations and difficulties, the Corps believes that it is necessary to continue to improve legal documents, mechanisms, policies, participating forces, command, direction and management mechanisms for emergency activities. Therefore, the promulgation of the Emergency Law is very necessary, creating a legal basis for law enforcement to enhance proactiveness in responding to and promptly and effectively overcoming emergency situations, contributing to protecting the State and the People, the rights and legitimate interests of organizations and individuals.
In Clause 3, Article 2 of the draft Law stipulates the explanation of the concept "State of emergency for major disasters is a state of emergency declared when a major disaster occurs (natural disasters, epidemics, environmental pollution, radiation and nuclear)... quickly stabilizes the situation", the unit proposes to study, supplement and edit it to: "State of emergency for major disasters is a state of emergency declared when a major disaster occurs due to natural disasters, epidemics, environmental pollution incidents, toxic chemicals, radiation and nuclear)... quickly stabilizes the situation" to ensure completeness and science. Because, with the scale of production, business, storage, transportation and use of chemicals in our country today and in the following years, it is not excluded that a major toxic chemical disaster may occur that level 3 civil defense measures cannot meet.

In Article 8, which stipulates “International cooperation on emergencies”, the unit proposes to study and supplement the provisions regulating the content of cooperation to exchange and learn experiences in organizing, preparing for response, transferring technology, raising awareness, capacity for prevention, warning, response, and overcoming consequences of emergency situations caused by disasters and epidemics.
In Article 13 "Measures applied in a state of emergency when there is a major disaster due to natural disasters, environmental pollution, radiation and nuclear incidents" researched and supplemented, revised to: "Measures applied in a state of emergency when there is a major disaster due to natural disasters, epidemics, environmental pollution incidents, toxic chemicals, radiation and nuclear incidents" and added a provision regulating measures to respond to toxic chemical incidents to ensure scientific nature, consistent with the proposed amendment to Clause 3, Article 2...
Concluding the meeting, Vice Chairman of the National Defense, Security and Foreign Affairs Committee Nguyen Hai Hung highly appreciated the results of the Chemical Corps' performance in responding to and overcoming CBRN and environmental incidents and emergencies; shared the difficulties and obstacles in the performance of the tasks, such as: limitations in information sharing, overlap in direction and operation, etc.
With the desire to develop a draft Law on State of Emergency to overcome the shortcomings arising in the process of law enforcement on state of emergency, the Vice Chairman of the Committee on National Defense, Security and Foreign Affairs emphasized that the sharing from practice and recommendations of the Chemical Corps is an important source of information for the Committee to continue to complete the review report of the draft Law with the highest quality, creating the best conditions for implementing activities when a state of emergency occurs.
