CONSIDER AMENDING THE LAW ON AN AS-needed basis rather than periodically
The discussion in the group focused on the additional assessment of the results of the implementation of the socio-economic development plan and state budget in 2023; the implementation of the socio-economic development plan and state budget in the first months of 2024; the practice of thrift and anti-waste in 2023; and the results of the implementation of national goals on gender equality in 2023.
Speaking at the discussion, Standing Member of the National Assembly's Law Committee Hoang Minh Hieu - National Assembly Delegate of Nghe An said that the content on institutional reform in the supplementary assessment report on the results of the implementation of the socio-economic development plan was mentioned very fully and deeply, clearly showing the viewpoint: institutional reform is one of the driving forces and important factors in implementing the Resolution of the 13th National Party Congress.
To deepen this content, the delegate of Nghe An proposed to add some advantages such as reforming the way of law making, specifically a number of laws with related scopes of regulation were issued at the same time such as: Land Law (amended), Housing Law (amended) and Real Estate Business Law (amended) recently.
According to the delegate, the above method has the advantage of clearly defining the scope of each law, ensuring the logic between related laws; thereby making the laws achieve a higher level of completeness; at the same time, adjusting the overall problems that still exist in the implementation process for businesses and people.
The delegates also highly appreciated the work of reviewing legal documents in the past time with 2 rounds of review since the beginning of the term; thereby discovering many contradictions and overlaps; clearly identifying bottlenecks in the law-making or implementation stage. At the same time, the review also serves as a basis and quality input information for law-making.
Thereby, delegate Hoang Minh Hieu proposed that the review of legal documents should be carried out regularly and continuously to have good input information to serve higher quality legislative activities.
Also related to this content, the delegate of Nghe An proposed to consider amending laws according to needs to resolve problems of people and businesses more promptly; instead of making periodic amendments after reviewing 5 years, summarizing 10 years of law implementation as usual.
Regarding concerns that amending laws as needed will lead to not ensuring the stability of the legal system, delegate Hoang Minh Hieu said that there should be no concern about this. Because through studying the experiences of some developed countries, the viewpoint on the stability of the law does not lie in frequently changing specific articles and clauses that are entangled in practice, but is approached by countries from the viewpoint of ensuring the general doctrine of the law, which is the important thing. Therefore, they also regularly amend laws if they find problems.
Regarding administrative procedure reform, through research and examination reports submitted by the National Assembly's Economic Committee, it is shown that the labor productivity of Vietnamese people in recent years has not reached the regional average. According to the delegate from Nghe An, one of the factors leading to the above situation is administrative procedures.
Quoting the opinion of a publishing house director who said that publishing a book requires about 100 signatures, delegate Hoang Minh Hieu commented: Prolonged administrative procedures affect production and business of enterprises, thus reducing labor productivity. Therefore, the Government needs to consider continuing to reform administrative procedures as a key task in the second half of this term.
HAVE SOLUTIONS TO BUILD A MORE SUITABLE STATE BUDGET ESTIMATES
Deputy Chairman of the National Assembly's Finance and Budget Committee Nguyen Van Chi - National Assembly Delegate of Nghe An presented opinions related to the additional assessment of the 2023 budget and implementation in the first 3 months of 2024.
Based on the analysis of additional data on state budget revenue in 2023, an increase of VND 133.4 trillion compared to the revenue estimate reported in October 2023, delegates said that the work of building annual budget revenue estimates is still not close, still lower than reality, leading to not only a narrowing of fiscal space, but also an unnecessarily higher budget deficit compared to actual needs.
Therefore, the delegate believes that the viewpoints on the work of building the annual state budget estimates stipulated in the State Budget Law need to be thoroughly re-evaluated; from there, they should be soon included in the National Assembly's Law and Ordinance Building Program for amendment in order to have a more appropriate and practical construction approach.
At the same time, the Vice Chairman of the National Assembly's Finance and Budget Committee also proposed resuming the provision of data on the "health" of enterprises to serve the work of more complete and appropriate socio-economic assessment.
In fact, there are still differences between the Government's report and the assessment of the National Assembly's Economic Committee. For example, in implementing the 2023 revenue estimate, the Government said that the revenue increase was relatively large in three areas: foreign-invested enterprises, non-state enterprises and state-owned enterprises.
Thus, from the revenue perspective, there will be a relatively positive view of the production and business situation of enterprises; but in the report of the Economic Committee, the production situation of enterprises is still really difficult.
In addition, based on the analysis of low increase in total consumer demand despite being exempted from 2% value added tax, delegate Nguyen Van Chi commented that the result showed that this tax incentive move seemed to have no impact on stimulating consumer demand to have a positive impact on businesses.
Therefore, the delegate from Nghe An said that the National Assembly needs to consider the Government's proposal to continue reducing 2% of added value to stimulate consumption until the end of this year.
OVERCOMING THE FEAR OF MAKING MISTAKES AND TAKING RESPONSIBILITY
Discussing the socio-economic situation, Major General Tran Duc Thuan - Standing Member of the National Assembly's Defense and Security Committee, National Assembly Delegate from Nghe An acknowledged the achieved results.
However, he also expressed concern when the Government report raised the issue of a number of cadres, civil servants and public employees having the mindset of being afraid of making mistakes and being afraid of responsibility.
“This is an issue that the Government needs to find a solution to. If we do not solve it well, this “disease” will gradually spread, affecting the implementation of socio-economic development goals in general,” said the delegate of Nghe An Delegation.
On the other hand, Major General Tran Duc Thuan also suggested that it is necessary to strengthen solutions to provide effective official information to orient public opinion against bad and toxic information; at the same time, he suggested that competent authorities strengthen internal political management, especially at the strategic level, the higher the level, the more strictly they must be managed.
Commenting on the results of implementing national goals on gender equality, Major General Tran Duc Thuan suggested fundamental solutions to eliminate the male-dominated ideology to overcome the higher birth rate of boys than girls in our country.
He also suggested that it is necessary to strengthen the effective implementation of propaganda and education on gender equality. Party committees and authorities at all levels should consider this an important task to develop plans, train and create sources of female cadres to increase the proportion of women participating in leadership and management at all levels; along with that, research and issue specific policies for women to create conditions for them to be "good at public affairs and good at housework".
