On October 25, the National Assembly held a discussion session on the Draft Law on Urban and Rural Planning. This is an important Law project, of key significance in orienting spatial development, creating a sustainable living environment for people, and promoting harmonious and effective socio-economic development. The discussion session attracted special attention from National Assembly deputies with many enthusiastic and multi-dimensional contributions.

"Bottlenecks" in concepts and spatial planning
Right from the beginning of the discussion, the concept of urban and rural areas became the focus of debate. Delegate Nguyen Thi Lan (Bac Giang Delegation) frankly pointed out that this concept in the draft Law is still unclear, lacking specificity, causing difficulties in applying it in practice.
According to delegate Lan: "The draft Law should add clear quantitative criteria on population size, population density, non-agricultural labor rate, technical infrastructure, social infrastructure... to distinguish urban and rural areas. This not only helps to classify urban and rural areas accurately but also serves as a basis for issuing appropriate development policies."
Sharing the same view, delegate Tran Van Binh (Ho Chi Minh City Delegation) mentioned the lack of regulations on inner city and urban areas. Delegate Binh analyzed: "Inner city and urban areas are the economic, political and cultural centers of the city, playing a particularly important role. The lack of clear regulations on this area will lead to a state of unsynchronized and fragmented development, affecting the effectiveness of management and exploitation of resources."
From that perspective, delegate Binh proposed that it is necessary to clearly define the scope, boundaries, and functions of the inner city and inner town areas, ensuring connectivity with other areas in the urban area.
Another "hot" issue that delegates are interested in is underground space planning. Delegate Pham Van Minh (Hanoi Delegation) emphasized: "For large cities such as Hanoi and Ho Chi Minh City, underground space is a valuable resource for developing technical infrastructure, transportation, services... Scientific underground space planning will help reduce the load on the ground space, solve traffic congestion, and improve the living environment".
Delegate Minh cited the experience of developed countries such as Japan and Singapore in exploiting underground space to build roads, shopping malls, parking lots, etc. and said that Vietnam needs to learn from this experience.
Consulting people: Avoid formalities
The issue of soliciting community opinions in planning also received many enthusiastic contributions. Delegate Le Thi Hoa (Nghe An Delegation) shared: "Practice shows that many planning projects are not suitable to the needs and aspirations of the people, leading to difficulties in the implementation process, even causing resentment in society."
Delegate Hoa proposed legalizing regulations on collecting community opinions, ensuring publicity and transparency, and at the same time building a strict monitoring mechanism to avoid the situation of collecting opinions for the sake of formality.
Delegate Nguyen Van Hung (Thua Thien Hue Delegation) expressed concern about the consistency and synchronization of the Law on Urban and Rural Planning with other laws. Delegate Hung analyzed: "Currently, there are many laws related to planning such as the Construction Law, Land Law, Environmental Protection Law... If the Law on Urban and Rural Planning is not closely linked with these laws, it will lead to overlaps and conflicts, causing difficulties in application". Delegate Hung suggested that it is necessary to review and adjust regulations to ensure the consistency and synchronization of the legal system.
Decentralization, delegation and resources: The "key" to success
Many National Assembly deputies focused on discussing the issue of decentralization and delegation of power in planning. Delegate Hoang Thi Thu (Quang Ninh delegation) emphasized: "Clear decentralization and delegation of power are important factors to improve the effectiveness and efficiency of state management of planning". Delegate Thu proposed to clearly define the authority and responsibility of authorities at all levels and sectors in formulating, appraising, approving and organizing the implementation of planning.
Resources for planning work are also a matter of concern to delegates. Delegate Do Van Nam (Hai Phong Delegation) said: "For planning work to be highly effective, it is necessary to ensure adequate and timely resources, including both financial and human resources." Delegate Nam suggested having a mechanism to mobilize resources from various sources, including the state budget, business investment capital, ODA capital... and at the same time training and fostering a team of highly qualified staff in the field of planning.

On behalf of the drafting agency, Minister of Construction Nguyen Thanh Nghi thanked the National Assembly deputies for their dedicated and responsible contributions. Emphasizing the importance of this draft law, Mr. Nghi affirmed that this is a draft law of special significance, directly and deeply affecting the implementation of construction investment projects of both businesses and people.
The Draft Law on Urban and Rural Planning has a close relationship with many provisions of other laws, especially the Law on Planning, the Law on Investment, and the Law on Land. Therefore, during the drafting process, the presiding agency was very careful and seriously reviewed to ensure consistency and synchronization with the current legal system, while ensuring feasibility in the actual implementation process.
During the discussion session, Minister Nguyen Thanh Nghi directly explained and clarified many issues of interest to National Assembly delegates.
Regarding the relationship between plans, he said: The draft law clearly stipulates the relationship between general planning, zoning planning, detailed planning, as well as the relationship between urban and rural planning and national planning, regional planning, and provincial planning.
Regarding the scope of planning, the scope of urban and rural planning is determined according to the territorial scope, ensuring consistency and connection between urban and rural spaces. The draft law will be further revised to clarify the scope of planning for each type of planning.
Regarding the explanation of terms, the Minister said that concepts such as "inner city" and "inner town" are not within the scope of this law but will be specifically regulated in the Law on Urban Development Management.
Regarding urban types, urban classification will be specified in the Law on Urban Development Management.
Regarding underground space planning, this is also the content that will be specified in detail in the Law on Urban Development Management.
Regarding the resolution of conflicts in planning, the draft Law clearly stipulates the order and procedures for handling conflicts between urban and rural planning, as well as between urban and rural planning and specialized technical planning...
Concluding the discussion session, Vice Chairman of the National Assembly Nguyen Duc Hai said that during the discussion session, 22 delegates spoke and 1 delegate debated. The National Assembly delegates basically agreed with many contents of the draft law, and at the same time contributed many specific and accurate opinions to complete the draft law.
Some issues that delegates were interested in and proposed included: Scope of regulation, subjects of application of the law; Interpretation of terms; Planning period and term; Consistency and synchronization with other laws; Relationship between types of planning; Principle of simultaneously establishing general plans; Handling conflicts between plans; Organizing public consultation; Using resources for planning work.
Vice Chairman of the National Assembly Nguyen Duc Hai affirmed that the National Assembly Standing Committee will fully absorb and study the opinions of the delegates to perfect the draft law before submitting it to the National Assembly for consideration and approval.
