Suspend 5-star hotel project due to illegal construction

On October 14, information from the People's Committee of Da Lat City ( Lam Dong ) said that there was a document directing the competent authorities, the People's Committee of Ward 10, requesting Khai Vy Joint Stock Company to strictly comply with the suspension of construction of Merperle Dalat Hotel, at No. 1, Hung Vuong Street, Da Lat City.

Merperle Dalat Hotel project located at No. 1, Hung Vuong Street, Ward 10, Da Lat City is considered to have the largest construction scale in Lam Dong province so far, with more than 400 rooms, 5-star international standard.

In document 6861/UBND-QH dated October 11, 2023, the People's Committee of Da Lat City determined that, through inspection, the Urban Management Department of Da Lat City and the People's Committee of Ward 10 discovered that the investor of the hotel project Merperle Dalat Hotel violated construction order, building a building with a design different from the granted license.

At basement 1, the investor built 7,092m2, exceeding the licensed construction permit by 1,315m2; similarly, basement 2 built 1,286m2 more than the licensed construction permit; the first floor built 955m2 more than the licensed construction permit and is constructing 900m2 of roof formwork, which is not included in the permit granted in 2021. Total floor area of the investor's violation at the hotel project Merperle Dalat Hotel is over 4,450m2.

The violation of Khai Vy Joint Stock Company was recorded by the People's Committee of Ward 10 on October 10, 2023 to complete the dossier and handle the violation according to the provisions of law.

In document 6861, Da Lat City People's Committee requested Khai Vy Joint Stock Company to strictly comply with the suspension of construction and comply with measures to handle violations; urgently contact the competent authorities to prepare a dossier to adjust the construction permit. In case the adjustment permit is not granted, the investor is forced to dismantle the violating items.

The People's Committee of Da Lat City has also assigned the People's Committee of Ward 10 to supervise the implementation of the suspension of construction, and not to allow investors to construct works or construction items without permission from competent authorities.

Previously, on September 22, 2023, Lam Dong Provincial People's Committee issued Document No. 8303/UBND-QH, reviewing Document No. 41/CV-KVG/2023 dated August 18, 2023 of Khai Vy Joint Stock Company regarding the request to adjust the construction design at the Merperle Dalat Hotel project.

The leaders of Lam Dong Provincial People's Committee agreed on the policy of adjusting the design of the Merperle Dalat Hotel project. Lam Dong Provincial People's Committee requested Khai Vy Joint Stock Company to complete the documents, procedures and processes to submit to the competent authority for appraisal and approval according to the provisions of law.
