Adjusting the inspection plan in the field of Industry and Trade

Accordingly, the 2025 Inspection Plan is adjusted to reduce 1 inspection by the Department of Industry and Trade Inspectorate on compliance with specialized laws in the field of renewable energy (hydropower, wind power, solar power) and acceptance of construction works under its management. Specifically, 8 power plants, including: 2 hydropower plants, 4 wind power projects, 2 solar power plants in the areas of Ham Thuan Bac, Bac Binh, Tuy Phong, Ham Thuan Nam and Phan Thiet.

The reason is that according to the provisions of Clause 5, Article 24 of Decree No. 61 (dated March 4, 2025) of the Government detailing a number of articles of the Electricity Law on Electricity Operation Licenses (effective from March 4, 2025): "The Provincial People's Committee is responsible for inspecting and examining organizations granted Electricity Operation Licenses under the licensing authority of the Provincial People's Committee regarding the maintenance of the conditions for electricity operations that have been granted Licenses according to the provisions of the Electricity Law and this Decree". However, for the 8 power plants (wind power, hydropower, solar power) mentioned above, the Electricity Regulatory Authority - Ministry of Industry and Trade (now the Electricity Authority) all granted Electricity Operation Licenses...

In addition, the Decision to Adjust the Inspection Plan for 2025 of the Provincial People's Committee also added an inspection subject, an enterprise operating in Phan Thiet Industrial Park - Phan Thiet City, to the inspection content of the Department of Industry and Trade Inspectorate on compliance with specialized laws on business (buying, selling gas; gas filling) of liquefied petroleum gas (LPG). The reason is that at the end of last year, the Ministry of Industry and Trade issued a Decision on promulgating the Inspection Plan for 2025, in which it assigned the Binh Thuan Market Management Department to conduct an inspection of compliance with legal regulations in gas business for the above enterprise and expected to conduct the inspection in the second quarter of 2025. However, on March 31, 2025, the Provincial People's Committee issued a Decision on the establishment of the Binh Thuan Provincial Market Management Department under the Department of Industry and Trade.

According to the provisions of Clause 5, Article 4 of Resolution No. 190 (dated February 19, 2025) of the National Assembly on handling a number of issues related to the reorganization of the state apparatus, it is stipulated that: "The agency receiving the functions, tasks and powers after the reorganization of the state apparatus shall continue to perform the tasks and procedures being performed by the agencies subject to the reorganization"... Thus, the Inspectorate of the Department of Industry and Trade is responsible for receiving the inspection of compliance with the provisions of law in gas business from the Market Management Department of Binh Thuan province (now the Market Management Sub-Department under the Department of Industry and Trade) - The Decision on Adjusting the Inspection Plan for 2025 of the province clearly states.
