Breakthrough new points of the Law on Promulgation of Legal Documents in 2025

On February 19, 2025, at the 9th Extraordinary Session, the 15th National Assembly passed the Law on Promulgation of Legal Documents (LDOs), which will take effect from April 1, 2025. The promulgation of this Law aims to remove institutional bottlenecks and continue to perfect the legal framework for the construction and operation of a unified, synchronous, transparent, feasible, accessible, effective, efficient, and easy-to-apply legal document system. Thereby, it contributes to unleashing all potentials and resources, creating new momentum for the country's rapid and sustainable development in the new era.

Accordingly, the Law on Promulgation of Legal Documents consists of 9 chapters and 72 articles (a reduction of 8 chapters and 101 articles compared to the 2015 Law, a reduction of 53% of the number of chapters and 58.4% of the number of articles). Introducing the breakthrough new points of the Law on Promulgation of Legal Documents 2025, Deputy Minister of Justice Nguyen Thanh Tinh said that the significant reduction in the number of chapters and articles compared to the Law on Promulgation of Legal Documents 2015 has institutionalized Conclusion No. 119-KL/TW on "amending the Law on Promulgation of Legal Documents in the direction of only specifically regulating the order and procedures for drafting and promulgating legal documents of the National Assembly and the National Assembly Standing Committee", ensuring a shortened time, but still improving productivity, promptly meeting the requirements of the country's development in the new era, ensuring the quality of legal documents, and at the same time supplementing content on the organization of implementation of legal documents.

In addition, the Law on Promulgation of Legal Documents 2015 has simplified the system of legal documents, including redefining the authority to promulgate legal documents of a number of entities according to the 2013 Constitution; the Law 2025 has removed the authority to promulgate legal documents of commune-level authorities; and added a form of legal document promulgated by the Government, which is a resolution to resolve urgent and important issues arising from practice.

At the same time, strongly innovate the annual legislative program with high flexibility, the policy process is implemented independently from the annual legislative program: The National Assembly Standing Committee decides on the annual legislative program based on the proposal submitted by the competent authority instead of building a dossier of proposals for the development of laws, ordinances, and resolutions to submit to the National Assembly Standing Committee, the National Assembly decides on the annual law and ordinance development program. This overcomes the formality in building the proposal dossier; clearly defines the authority of the Government to decide on policies in the law development process, the National Assembly, the National Assembly Standing Committee considers and approves laws.

The Law on Promulgation of Legal Documents 2025 also added a form of consultation as policy consultation in the process of formulating policies for draft laws, resolutions of the National Assembly, and ordinances of the National Assembly Standing Committee. This is one of the new forms of consultation to overcome current shortcomings and limitations in the law-making process, especially in the process of proposing policy development that has not received due attention and the proposed policies are still general.

According to the Law on Promulgation of Legal Documents 2025, the policy process plays an important role, the quality of the policy will determine the quality of the draft legal document. Through policy consultation activities, the policy proposing agency will seek consensus, choose the optimal solution, perfect the policy as a basis for drafting legal documents, as well as ensure the feasibility of the policy in life.

In addition, the Law on Promulgation of Legal Documents 2025 also added regulations on the organization of the implementation of legal documents. This is a new point of the Law, overcoming the cause of the legal documents not clearly defining which activities belong to the organization of law enforcement and stipulating the responsibilities and obligations of the subjects. Therefore, the implementation of the organization of law enforcement has not been effective and substantive.

According to the 2025 Law, the organization of the implementation of legal documents has stipulated the basic contents for competent agencies and individuals to organize the implementation of legal documents after they are issued; the responsibility for organizing the implementation of legal documents and reporting or providing information on the organization of implementation. In addition, in the content of organizing the implementation of legal documents, the 2025 Law also added regulations guiding the application of legal documents, accordingly, competent agencies and individuals issuing legal documents shall consider and guide the application of documents issued by themselves in administrative documents, based on the request of agencies, organizations and individuals.

In addition, the Law on Promulgation of Legal Documents 2025 also has new contents on the responsibilities of heads of agencies in the process of developing and organizing the implementation of legal documents; application of digital technology and digital transformation in document development; resources to ensure the development and implementation of legal documents...

To promptly and effectively implement the Law, the Government will focus on directing the development of a Plan to implement the Law, develop documents detailing the implementation of the Law, ensuring that it takes effect simultaneously with the Law on April 1, 2025.
