Di Linh: Expected to reclaim more than 318 hectares of land to implement Bao Loc

The total land area to be recovered to implement the expressway project through Di Linh district is more than 318 hectares with 1,278 households having land subject to recovery and affected assets in the communes of Dinh Trang Hoa, Lien Dam, Tan Chau, Tan Nghia, Dinh Lac, Gia Hiep and Tam Bo.

Di Linh District People's Committee will carry out compensation, site clearance, support and resettlement for households whose land is located in the recovered area.

It is expected that in April 2025, the People's Committee of Di Linh district will direct relevant units and localities to organize meetings with people in the land acquisition area to disseminate and receive opinions.

The People's Committee of Di Linh district will issue and send a notice of land recovery to each organization and individual whose land is recovered, the owner of the property attached to the land, and the person with related rights and obligations (if any); at the same time, post the notice of land recovery at the headquarters of the People's Committee of the commune and the common living place of the residential area where the land is recovered during the period of compensation, support, and resettlement.

In case of failure to contact or send land recovery notice to organizations and individuals whose land is recovered, owners of assets attached to the land, and people with related rights and obligations (if any), the Commune People's Committee shall notify in one of the central and provincial daily newspapers for 3 consecutive issues and broadcast on the central and provincial radio or television 3 times in 3 consecutive days; post at the headquarters of the Commune People's Committee and the common living place of the residential area where the land is recovered; coordinate with the Department of Culture, Science and Information; Office of the People's Council and the District People's Committee to post on the District People's Committee's Electronic Information Portal throughout the compensation, support and resettlement period.

It is expected that by the end of June 2024, the investigation, survey, measurement, and counting work will be carried out to develop, approve, and publicize the compensation and resettlement support plan. The decision to reclaim land will be implemented in accordance with Clause 5 and Clause 6, Article 87 of the 2024 Land Law (expected 10 days after the decision to approve the compensation, support, and resettlement plan is issued) and the reclaimed land fund will be handed over to the investor.

For organizations, households and individuals currently using land and assets on land subject to recovery, the land must be handed over to the competent authority at the time of receiving compensation, support and resettlement according to the approved plan. In case organizations, households and individuals do not receive compensation and support according to the approved plan, the approved compensation and support will be deposited into the account of the Organization performing the compensation, support and resettlement tasks opened at a commercial bank according to the provisions of Clause 4, Article 94 of the 2024 Land Law.

In case the person using the recovered land has been mobilized and persuaded but does not comply with the handover of land to the organization in charge of compensation and site clearance, the Chairman of the District People's Committee will issue a decision to enforce the land recovery and organize the enforcement according to the provisions of Articles 87 and 89 of the 2024 Land Law.

For households and individuals who are eligible for resettlement, they will be resettled in residential areas and resettlement projects according to the provisions of Article 111 of the 2024 Land Law.
