Ministry of Home Affairs proposes new regulations on electronic transactions in the field of social insurance

The Ministry of Home Affairs is drafting a Decree regulating electronic transactions in the field of social insurance (SI) and the National Database on Insurance.

In the draft, the Ministry of Home Affairs devotes 1 chapter (including 16 articles) to regulating electronic transactions in the field of social insurance. This chapter is structured into 3 sections: Section 1 regulates electronic social insurance documents; Section 2 regulates the rights and obligations of agencies, organizations and individuals when participating in electronic transactions in the field of social insurance; Section 3 regulates the implementation of electronic transactions in the field of social insurance.

The content of this chapter basically inherits the provisions of Decree No. 166/2016/ND-CP dated December 24, 2016, amended and supplemented by Decree No. 140/2018/ND-CP dated October 8, 2018 of the Government; at the same time, it is adjusted in accordance with the provisions of the Law on Electronic Transactions 2023 and detailed regulations. In addition, the draft also proposes to adjust the contents to suit the practical implementation process such as: Reducing the processing time of the Social Insurance agency when receiving a request for registration to use, adjust information and stop using electronic transaction methods in the field of Social Insurance (from 03 working days to 02 working hours); abolish the regulations on the responsibility of the I-VAN Organization in providing full information, data and implementing the periodic and ad hoc reporting regime on I-Van service provision activities as required by Vietnam Social Security (currently, this information and data have been centrally managed and fully stored at the Vietnam Social Security Data Center).

Proposal to supplement regulations on electronic social insurance books

In addition, the draft proposes to add regulations on electronic social insurance books.

Accordingly, the electronic social insurance book is issued by the social insurance agency to each social insurance participant in the electronic environment. The electronic social insurance book has the same information as the paper social insurance book and is encoded according to the provisions of law. Information in the electronic social insurance book includes (i) Social insurance code; (ii) Basic personal information including: Full name; date of birth; gender; nationality; ID number or passport number; (iii) Information on the social insurance payment process (payment period; basis for social insurance payment; contribution rate to social insurance funds and related information associated with the payment process such as rank, position; job title, job; name of unit; workplace, etc.); (iv) Information on enjoying and resolving social insurance regimes; (v) Other necessary information related to the payment and enjoyment of social insurance.

The electronic social insurance book is linked to the level 2 electronic identification account (VNeD) of the social insurance participant. Social insurance participants can use handheld electronic devices in the electronic environment to receive the electronic social insurance book.

The draft clearly states that the electronic social insurance book must be issued no later than January 1, 2026 and has the same legal value as the paper social insurance book.
