(CLO) The Ministry of Information and Communications is soliciting comments on the draft Press Law (amended) with many notable new regulations.


People working at scientific journals are not granted press cards.

This draft law also provides notable regulations on press management. Specifically, the Ministry of Culture, Sports and Tourism is responsible to the Government for implementing state management of the press from the Ministry of Information and Communications.

Regarding the press management agency, the draft Law on Press (amended) also adds a number of powers and duties. Accordingly, the management agency has the right to appoint the head and deputy head of the press agency after obtaining written consent from the Ministry of Culture, Sports and Tourism. At the same time, it has the right to dismiss or remove the head and deputy head of the press agency according to regulations.

Regarding press cards, the Government stipulates the conditions for granting press cards; cases in which press cards are not considered for granting, changing press cards, and revoking press cards. The dossier and procedures for granting, changing, and re-granting press cards are stipulated by the Minister of Culture, Sports and Tourism. Therefore, the validity period of a press card is 05 years from the date of issuance and is stated on the card. When the validity period of a press card expires, the Ministry of Culture, Sports and Tourism will consider granting a new press card.

Notably, in the new draft law, there is a provision: "People working at scientific journals are not granted press cards" . Only people working in press agencies as reporters and editors are considered for press cards.

At the same time, the draft also introduces the concept of magazine to clearly distinguish between newspapers and magazines. Specifically, a magazine is a press product published periodically, posting news and articles of a specialized, specialized nature, exchanging and guiding professional activities according to the principles and purposes specified in the license. Magazines only update news and events about the activities of the governing body (including printed magazines and electronic magazines).

Managing representative offices and local correspondents

The draft Law on Press (amended) also adds new regulations on the management of representative offices and resident reporters in localities.

Accordingly, the People's Committee at the provincial level is responsible for state management of the press for local press agencies, representative offices, local resident reporters and other activities according to Government regulations.

Press agencies are allowed to set up representative offices and send resident reporters at home and abroad.

Press agencies that set up representative offices or assign resident reporters in provinces or centrally run cities must notify the People's Committee of the province where the press agency sets up representative offices or assigns resident reporters.

For the first time, there are regulations on the model of the Press and Media Group.

Notably, the bill adds provisions on the Press and Media Group model. Accordingly, press agencies operating under the Press and Media Group model are allowed to have a number of affiliated press agencies; are allowed to have financial, labor, and salary mechanisms like enterprises; are allowed to have affiliated enterprises or contribute capital to enterprises.

The Government is the agency assigned to specify in detail the conditions, criteria, authority to establish, operating model, and financial mechanism of press and media groups.

According to the provisions of Clauses 16 and 17, Article 2 of the draft law, the Press and Media Group is an operational model of a press agency with many types of press, with affiliated press agencies and affiliated enterprises, meeting the conditions prescribed by the Government. In addition, the main multimedia media agency is a press and media group operating in many types and services, playing a core role in orienting public opinion, and having a specific operating mechanism.

“The head of the Press and Media Group is the General Director,” the bill states.
