The Ministry of Labor, War Invalids and Social Affairs (MOLISA) is drafting a Decree on voluntary occupational accident social insurance for employees working without a labor contract, with three modes, the State supports the highest contribution level equal to 30% of the poverty line.
According to the Ministry of Labor, Invalids and Social Affairs, workers without labor contracts account for the majority of our country's workforce, with 33 million people as of the end of the first quarter of 2023. However, many workers in this sector are suffering from serious occupational accidents (OAs) during the work process. Just counting the number of workers without labor contracts who died due to occupational accidents in the past 5 years, an average of over 2,000 people per year, nearly twice as many as the sector with labor relations.
Currently, there are commercial insurance products for occupational accidents in Vietnam that are being provided by insurance companies in the form of health insurance. However, because commercial insurance is aimed at profit, there are limitations in ensuring social security for victims and their relatives, such as: Lack of long-term payment regime to compensate for loss of income; poor people do not have the conditions to participate; have to pay on time even when unemployed...
Therefore, according to the Ministry of Labor, Invalids and Social Affairs, voluntary social insurance for occupational accidents in Vietnam needs to be built on the basis of overcoming the limitations of commercial insurance, while inheriting the superiority of compulsory social insurance for occupational accidents in ensuring social security.
Draft Decree on voluntary occupational accident social insurance for employees working without labor contracts, prescribed by the Ministry of Labor, Invalids and Social Affairs, stipulates 3 voluntary occupational accident insurance regimes: Assessment of the level of reduced working capacity; One-time allowance, monthly allowance, service allowance; Support for living aids and orthopedic devices.
Employees are considered for voluntary occupational accident insurance when they meet the following conditions:
Having a 5% or more reduction in working capacity due to a work accident occurring during the period of participation in voluntary work accident insurance. The work accident occurs during the period of participation in voluntary work accident insurance (except for the following cases: Conflict between the victim and the person causing the accident that is not related to work or work duties; the employee intentionally self-harms; uses drugs or other addictive substances contrary to the provisions of law).
Workers whose working capacity is reduced from 5% to 30% due to occupational accidents are entitled to a one-time allowance at the following levels: 5% reduction in working capacity is entitled to five times the basic salary, then for each additional 1% reduction, an additional 0.5 times the basic salary. In addition to the prescribed allowance, workers are also entitled to an additional allowance calculated based on the number of years of voluntary occupational accident insurance contributions, with each additional year of contribution from the second year onwards being calculated at an additional 0.3 times the basic salary.
Relatives of workers who die due to work-related accidents are entitled to a one-time benefit equal to thirty-six times the basic salary.
Workers with a 31% or more reduction in working capacity due to work-related accidents are entitled to a monthly allowance. The monthly allowance is stipulated as follows: A 31% reduction in working capacity is equal to 30% of the basic salary, then for each additional 1% reduction, an additional 2% of the basic salary is entitled to. In addition to the prescribed allowance, workers are also entitled to an additional monthly allowance calculated based on the number of years of voluntary work-related accident insurance contributions, from one year or less, it is calculated as 0.5% of the basic salary, then for each additional year of contribution to the fund, an additional 0.3% of the basic salary is calculated.
The monthly voluntary occupational accident insurance premium is equal to 2% of the regional minimum wage as prescribed by the Government. Employees pay monthly, every 3 months, every 6 months, every 12 months.
Employees participating in voluntary occupational accident insurance are supported by the State with a percentage of the monthly occupational accident insurance premium, including: 30% for voluntary occupational accident insurance participants from poor households according to the poverty line of rural areas;
Equal to 25% for voluntary occupational accident insurance participants belonging to near-poor households according to the poverty line of rural areas; multidimensional poor households lacking health insurance criteria;
Equal to 10% for other workers.
