The latest draft of the Law on Teachers adds provisions related to the rights of teachers.
Removing limitations and shortcomings in the management and operation of university-affiliated enterprises.
Notably, educators are permitted to conduct scientific research and transfer research products in accordance with the laws on scientific research and intellectual property.
They are allowed to participate in the management and operation of businesses established by higher education institutions operating in the field of scientific development, application, and technology transfer.
Previously, in a report addressing and explaining this matter, the Chairman of the Committee on Culture and Education, Nguyen Dac Vinh, stated that there were suggestions to add the right of teachers to participate in the management and operation of technology businesses within higher education institutions.
The Standing Committee of the Committee on Culture and Education stated that currently, the Law on Higher Education stipulates that higher education institutions are permitted to establish businesses.
According to relevant laws such as the Law on Public Employees, the Law on Enterprises, and the Law on Prevention and Combat of Corruption, public employees are not allowed to participate in the management or operation of enterprises, except in cases where specialized laws provide otherwise.
In response to the opinions of National Assembly deputies, and to address the limitations and shortcomings in the management and operation of enterprises under higher education institutions, the reviewing agency and the drafting agency have unanimously proposed adding rights for teachers.
Accordingly, they are allowed to participate in the management and operation of enterprises established by higher education institutions operating in the field of scientific development, application, and technology transfer.
Simultaneously, review and amend the provisions of relevant laws in the transitional clauses.
Allowing teachers to participate in business management is "extremely revolutionary."
At the 42nd session of the National Assembly Standing Committee, commenting on this issue, the Chairman of the National Assembly's Science and Technology Committee, Le Quang Huy, stated that the Law on Public Employees already stipulates that lecturers have the right to contribute capital; however, the current Law on Public Employees prohibits them from participating in the management of businesses and companies.
Mr. Huy also stated that the Committee on Science and Technology is currently reviewing and reporting to the competent authorities on amending the legal system to serve innovation, science, and technology.
"We are in discussions with relevant agencies to clearly state our position that faculty members should be allowed to invest in and participate in the management of startup businesses."
Essentially, these are businesses that use intellectual property—the results of research—to bring products to market, clearly demonstrating the connection between research institutes and universities with businesses. This should be strongly supported," Mr. Huy stated.
According to Nguyen Thanh Hai, Head of the Committee on Delegate Affairs, the regulation allowing teachers to participate in business management is "extremely revolutionary" and contributes to the implementation of Resolution 57 of the Politburo.
Based on her practical experience teaching at Hanoi University of Science and Technology, Ms. Hai believes that the formation of technology enterprises within higher education institutions is extremely important and contributes to the development of the country's technology sector.
Universities often have models like technology "incubators," where technological ideas are transferred to science and technology businesses within the university.
The teachers at the school are the principal investigators of scientific research projects at various levels, and their ideas and projects in technology "incubators" are transferred to businesses run and managed by the teachers themselves.
This will be extremely advantageous, making a significant contribution to the implementation of Resolution No. 57, "unleashing" technologists who are also educators in major universities.
