The National Assembly Standing Committee has just sent to National Assembly deputies a report on the National Assembly's Resolution on taking a vote of confidence and voting for people holding positions elected and approved by the National Assembly and People's Councils.
This resolution is expected to replace Resolution 85 of 2014, preparing for a mid-term vote of confidence for positions elected and approved by the National Assembly and People's Councils at the end of this year.
After many rounds of reception and revision, in the latest report, the National Assembly Standing Committee proposed a number of cases where a vote of confidence is not required to be taken to seek the National Assembly's opinion.
Specifically, no vote of confidence will be taken for people who are on medical leave for serious illness with confirmation from a medical facility and have not been in charge of work for 6 months or more according to the decision of a competent agency or individual, up to the time of the opening of the vote of confidence meeting.
The National Assembly will conduct a vote of confidence for positions elected and approved by the National Assembly at the session at the end of this year.
In addition, the new draft resolution proposes not to take a vote of confidence for those who have announced their retirement, announced their retirement, or were appointed or elected in the year of the vote of confidence.
Previously, Resolution 85 only stipulated one case of not taking a vote of confidence: a person whose continuous tenure in office is less than 9 months, calculated from the opening date of the session organizing the vote of confidence of the National Assembly and People's Council.
The report of the National Assembly Standing Committee stated that, through summarizing the practice of taking votes of confidence and comments from many agencies, the majority of opinions of the National Assembly Standing Committee agreed that it was necessary to add the above provisions to the new draft resolution.
Grounded, humane
In the review report of the National Assembly's Law Committee on this content, the review agency agreed with the scope of subjects for which the National Assembly and People's Councils will take a vote of confidence, vote of no confidence, and cases where a vote of no confidence is not taken as in the draft.
Accordingly, the examining authority believes that the addition of the regulation of not taking a vote of confidence for people who are on medical leave for serious illness with confirmation from a medical facility and have not been in charge of work for 6 months or more according to the decision of a competent agency or individual is based on practice, demonstrates humanity and is consistent with the requirements of taking a vote of confidence at the National Assembly and People's Councils.
In addition, this agency has suggested that it is necessary to clearly state that the period of non-operation is from 6 consecutive months. or more to ensure tightness.
In addition, regarding the subjects of the vote of confidence, the National Assembly Law Committee requested the drafting agency to explain more clearly the reason why the draft resolution does not include a number of positions elected or approved by the National Assembly or People's Council to be subject to a vote of confidence, such as judges of the Supreme People's Court, members of the National Defense and Security Council, deputy heads of the People's Council, and jurors of the People's Court.
Low credit then resign
In addition to the subjects of the vote of confidence, the new draft resolution also amends the provisions on the consequences of the vote of confidence in Resolution 85 to institutionalize Regulation 96 of the Politburo on the vote of confidence issued last February.
Specifically, the draft stipulates that if a person who is subject to a vote of confidence is rated "low confidence" by more than half to less than two-thirds of the total number of National Assembly deputies and People's Council deputies, he/she must resign. In case he/she does not resign, the agency or person with the authority to recommend that person for the National Assembly or People's Council to elect or approve is responsible for submitting to the National Assembly or People's Council for a vote of confidence at that session or the nearest session.
If a person subject to a vote of confidence is rated "low confidence" by two-thirds or more of the total number of National Assembly deputies or People's Council deputies, the agency or person with the authority to recommend that person for election or approval by the National Assembly or People's Council shall be responsible for submitting to the National Assembly or People's Council for dismissal at that session or the nearest session.
In the latest submission, the National Assembly Standing Committee also withdrew the proposal that people with low trust levels must resign within 10 days as in the previous submission.
As planned, the National Assembly will discuss the draft resolution on the afternoon of June 9 at the ongoing 5th session and pass it at the meeting on June 23.
