The Ministry of Justice is reviewing a draft decree amending Clause 2, Article 12 of Decree 03/2017 of the Government on casino business.
New casino in Phu Quoc is now operational
The Ministry of Finance’s report stated that in 2016, the Politburo agreed to allow two casino projects in Phu Quoc and Van Don to pilot allowing Vietnamese people to play. Currently, only the casino project in Phu Quoc has been operational since January 2019.
According to Decree 03, the pilot will end in January 2022 and the Government will conduct a summary assessment.
From January 2022 to August 2023, the Government and the Government Party Committee have summarized and evaluated the pilot project of allowing Vietnamese people to play at Phu Quoc casino business locations to report to the Politburo for approval.
Based on the report of the Party Committee of the Ministry of Finance on a number of important issues related to the management of casino activities in Vietnam, in May 2024, the Politburo concluded.
In particular, with the pilot project allowing Vietnamese people to play at casinos, it is agreed to extend the pilot period for allowing Vietnamese people to play at casinos until the end of 2024 with the project in Phu Quoc (Kien Giang).
For the project in Van Don, Quang Ninh province (if any), the pilot period for Vietnamese people to play in casinos is 3 years from the date the project starts casino business.
Along with that, the Government Party Committee is assigned to develop and complete a decree on casino business.
To soon institutionalize the above regulation, the Ministry of Finance submitted to the Prime Minister for permission to develop and issue a decree amending and supplementing Decree 03/2017 with the content of extending the pilot period allowing Vietnamese people to play at casino business locations according to shortened procedures.
With the decree comprehensively amending Decree 03/2017, the Ministry of Finance will coordinate with ministries and branches to build according to the normal process of building legal documents...
The pilot project with the first casino will be extended until December 31, 2024.
Regarding the content of amendments, supplements, and pilot implementation period, the draft decree clearly states that for the first casino business enterprise that is authorized by the competent authority to pilot allowing Vietnamese people to play in the casino, the pilot implementation period will end on December 31, 2024.
For other casino businesses that are permitted by competent authorities to pilot allowing Vietnamese people to play in casinos (if any), the pilot implementation period is 3 years from the date of being granted a certificate of eligibility to operate a casino.
The Ministry of Finance shall preside over and coordinate with the Ministry of Public Security, the Ministry of Planning and Investment, the Ministry of Culture, Sports and Tourism, the State Bank of Vietnam and the People's Committees of provinces and cities where there are enterprises permitted to pilot the admission of Vietnamese people to casinos to summarize, evaluate and report to the Government for reporting to competent authorities for consideration and decision on ending or continuing the pilot admission of Vietnamese people to casinos with the following time:
Before October 31, 2024, the first casino business enterprise will be allowed by the competent authority to pilot allowing Vietnamese people to play at the casino business location.
Before 60 days from the end of the pilot for other casino businesses licensed by competent authorities (if any).
Based on the decision of the competent authority, the Government issues a resolution on terminating or continuing to allow Vietnamese people to enter casinos.
In case the Government has not issued a resolution at the end of the pilot period, the pilot enterprise will temporarily stop allowing Vietnamese people to play in casinos until the Government issues a resolution.
In case the competent authority does not allow Vietnamese people to continue playing in casinos, the pilot enterprise will stop allowing Vietnamese people to play in casinos from the date the Government issues the resolution.
In case the competent authority allows Vietnamese people to continue playing in casinos, enterprises are allowed to allow Vietnamese people to play in casinos from the date the Government issues the resolution and comply with the regulations on allowing Vietnamese people to play in casinos in this decree.
In the current Decree 03/2017, the pilot implementation period is 3 years, from the date the first casino business is allowed to pilot allowing Vietnamese people to play at the casino business location.
After 3 years of piloting, the Government will summarize, evaluate and decide whether to continue allowing Vietnamese people to play casino or possibly stop allowing Vietnamese people to play casino in Vietnam.
