Scope of regulation and applicable subjects

This draft Decree stipulates the level of support for people working full-time on digital transformation, network information security, and network security in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, socio-political organizations from the central to communal levels, and armed forces (Army, Police, Cryptography). (Article 1)

The subjects of application are those who specialize in digital transformation, network information security, and network security as prescribed in Article 1 of this Decree, who undertake work related to the specialized job position in information technology management (including: Information technology industry, information technology application, digital transformation), electronic transactions, network information security, and network security (hereinafter referred to as those who specialize in digital transformation) at units specializing in digital transformation, network information security, and network security, including:

1. Cadres, civil servants, public employees.

2. Officers and non-commissioned officers: Professional and technical expertise of the People's Public Security.

3. Officers, professional soldiers, defense workers and civil servants of the People's Army .

4. People doing secretarial work.

Monthly support level

Article 3 of the above Draft Decree proposes:

1. The support level of VND 5,500,000/month applies to people working full-time on network information security and network security;

2. The support level of 3,500,000 VND/month applies to people working full-time in information technology management and electronic transactions;

3. The support levels prescribed in Clauses 1 and 2 of this Article shall be paid together with the monthly salary and shall not be used to calculate social insurance and health insurance contributions and benefits.

Time not counted towards support level

The time not counted for the support level proposed in Article 4 of the Draft Decree. Specifically as follows:

1. Continuous unpaid leave of absence of 1 (one) month or more.

2. Time off work to enjoy social insurance benefits according to the provisions of the law on social insurance.

3. Time of detention, temporary detention, temporary suspension from work or suspension from work.

4. The period of not holding the job position in Article 2 of this Decree is continuously from 1 (one) month or more.

According to the Ministry of Home Affairs, through reports from ministries, branches and localities, recruiting people with information technology qualifications to work in state agencies faces many difficulties due to: Low salaries and policies; low promotion and development opportunities; inadequate working environment (equipment, facilities) not attractive enough to attract high-quality information technology staff; there is a situation where civil servants and public employees, after being recruited, quit their jobs to move outside the private sector.

Therefore, in addition to building a synchronous and modern information technology infrastructure and a quality working environment, an urgent requirement today is to have reasonable policies and regimes for the team working in digital transformation, information security, and network security in state agencies, in order to retain and create conditions for cadres, civil servants, and public employees to work with peace of mind.

However, in reality, in addition to general policies and regimes for IT workers, digital transformation workers, information security workers, and network security workers, there are no separate support policies, although the nature of the work requires specialized knowledge, skills, and experience in information technology. There are very few agencies and localities that have issued support policies (monthly support policies or one-time recruitment, training) for IT workers, such as: Ministry of Science and Technology, Ministry of Construction, Dong Thap province, Phu Yen province, Lang Son province, Nghe An province... However, in general, the policies and regimes are not enough to attract people with IT qualifications.

Therefore, the Ministry of Home Affairs believes that the development of a policy with the above support level is to ensure the correlation of regimes and policies for the team of cadres, civil servants and public employees in general and the practical requirements for the use of human resources for digital transformation, information security and network security, contributing to attracting and encouraging high-quality human resources for digital transformation, information security and network security in the public sector to work with peace of mind and make long-term contributions. At the same time, it is necessary to promote the role of the head of the agency managing cadres, civil servants and public employees in implementing the support level based on the requirements of the approved job position.

This is also to meet the common goal of institutionalizing the Party's policy on building development policies, promoting, encouraging, and attracting high-quality human resources and talents to meet the requirements of national digital transformation.

Effectively implement the Party and State's policies on digital transformation, application of information technology in state management, administrative reform, ensuring connectivity and synchronization with appropriate regulations in relevant legal documents. Perfect the law on support levels for those working in full-time positions on digital transformation, network information security, network security, ensuring the implementation of the Decree is feasible, effective and efficient.
