In which, the Government agreed on the necessity, objectives, and viewpoints of amending the Law on Social Insurance (amended), and assessed that the draft Law on Social Insurance (amended) has many complicated contents, deeply affecting the social security system and workers.

Accordingly, the Government basically agrees on issues such as reducing the minimum social insurance payment period to receive pension from 20 years to 15 years; expanding the group of subjects participating in compulsory social insurance..., especially agreeing on the proposal to reduce the age of receiving social pension benefits from 80 years old to 75 years old.
This proposal will increase benefits, increase attractiveness, and attract people to participate in social insurance to ensure long-term social security for people, aiming to achieve the goal of Resolution 28-NQ/TW dated May 23, 2018 of the 12th Central Executive Committee on reforming social insurance policies.
In the latest draft of the Social Insurance Law that the Ministry of Labor, War Invalids and Social Affairs is seeking opinions on, the subjects applying for social pension benefits are Vietnamese citizens aged 60 or older and of retirement age according to the provisions of law. To receive social pension benefits, citizens must meet the following conditions: - 75 years of age or older; - No pension, other monthly social insurance benefits as prescribed by the Government. Regarding the age requirement for receiving social pension benefits, the Government shall report to the National Assembly for decision on gradually adjusting the age for receiving social pension benefits in accordance with the socio-economic development conditions and the capacity of the state budget in each period. The Government assigned the Minister of Labor, War Invalids and Social Affairs, authorized by the Prime Minister, to sign on behalf of the Government the Report to the National Assembly on the draft Law on Social Insurance (amended).
There will be 02 options for the proposal to withdraw social insurance at one time.
Also in Resolution 114/NQ-CP dated July 28, 2023, the Government assigned the Ministry of Labor, War Invalids and Social Affairs to preside over and coordinate with relevant agencies to fully absorb the opinions of Government members and complete the content of the draft Law on Social Insurance, including the issue of one-time withdrawal of social insurance, which is quite complicated and has a great impact on economic and social life.
Therefore, the Ministry of Labor, War Invalids and Social Affairs can propose 02 options to seek the National Assembly's opinion. These two options need to express the viewpoint and basis for choosing a specific option and research regulations on practical measures to support and encourage employees to voluntarily reserve their time participating in social insurance to receive pensions instead of receiving social insurance in one lump sum.
In addition, to perfect the provisions in the draft Law on Social Insurance, it is necessary to institutionalize and concretize the Party's policies and guidelines on social insurance; continue to summarize relevant legal regulations and remove difficulties from practice, fully assess the theoretical basis and grounds to determine issues that need to be inherited, issues that need to be supplemented, perfected or issues that need to be abolished;
Organize to collect opinions from affected subjects, consult experts, scientists, refer to international experience; implement decentralization and delegation of authority associated with inspection and supervision activities; diversify resources to mobilize organizations to implement the law...
