The Ministry of Home Affairs is consulting on developing policies for part-time workers at the commune, village, and residential group levels.
Deputy Minister of Home Affairs Vu Chien Thang signed an official dispatch to the People's Committees of provinces and centrally-run cities on policies for part-time workers at the commune, village, and residential group levels.
Accordingly, implementing the policy of "ending the use of non-professional workers at the commune level" in Conclusion 137-KL/TW dated March 28, 2025 of the Politburo and the Secretariat on the Project on rearranging and reorganizing administrative units at all levels and building a 2-level local government organization model, the Ministry of Home Affairs has the following opinions:
Currently, part-time workers at the commune, village, and residential group levels who are redundant due to the rearrangement of administrative units at the commune level and retire within 12 months from the date of the rearrangement decision by the competent authority are entitled to policies according to the provisions of Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government regulating the policy of streamlining payroll.
However, because the monthly allowance for non-professional workers at the commune, village and residential group levels is currently not high, the subsidy level for these subjects is redundant due to the arrangement of administrative units at the commune level, which is still low.
Therefore, to facilitate the settlement of policies for part-time workers at the commune, village, and residential group levels who retire immediately according to Conclusion 137-KL/TW in 2025, the Ministry of Home Affairs requests the Provincial People's Committee to study and propose policies for part-time workers at the commune, village, and residential group levels and send them to the Ministry of Home Affairs for the Ministry of Home Affairs to synthesize and submit to the Government for consideration and decision.
Previously, on April 15, Minister of Home Affairs Pham Thi Thanh Tra, Deputy Head of the Standing Committee of the Steering Committee for the arrangement of administrative units at all levels and the development of a model for organizing two-level local governments, signed Official Dispatch No. 03/CV-BCĐ on the orientation of a number of tasks for the arrangement of administrative units and the organization of two-level local governments; on the organization of the apparatus, cadres, civil servants and public employees when implementing the arrangement.
According to the Steering Committee, the current use of non-professional workers at the commune level will end from August 1, 2025. Local authorities are assigned to consider and arrange non-professional workers at the commune level to meet the requirements of the task to participate in work in villages and residential groups and implement policies and regimes for cases where work is not arranged according to regulations.
Continue to identify villages and residential groups as self-governing organizations of residential communities, not administrative levels.
For now, the existing villages and residential groups will be kept intact. After completing the arrangement of administrative units at all levels, the Government will assign the Ministry of Home Affairs to study and provide guidance under the direction of competent authorities on the arrangement and reorganization of villages and residential groups in a streamlined manner, directly serving the lives of the local community.
Currently, it is estimated that there are more than 400,000 part-time workers nationwide. In recent times, the support policies for part-time workers at the commune, village, and residential group levels who are redundant due to mergers have been a matter of concern to many people.
According to Decree 29/2023/ND-CP dated June 3, 2023 of the Government regulating the streamlining of payroll, the subjects of payroll streamlining are non-professional workers at the commune level, in villages and residential groups who are redundant due to the arrangement of commune-level administrative units and who retire within 12 months from the date of the arrangement decision of the competent authority, and are entitled to the following allowances:
a) For non-professional workers at the commune, village, and residential group levels holding elected positions: For each month of retirement before the end of the term, they will receive a subsidy equal to half of the current monthly allowance. For those who retire before the end of the arrangement roadmap, the number of months of subsidy will be calculated by the number of months of retirement before the retirement date mentioned above;
b) For non-professional workers at the commune, village, and residential group levels holding non-elected positions: For each month of retirement before the end of the placement roadmap, they will receive a subsidy equal to half of the current monthly allowance. For those who retire before the end of the placement roadmap, the number of months of subsidy will be calculated by the number of months of retirement before the retirement date mentioned above.
However, many non-professional officials at the commune level have sent their concerns to the Government Portal and the Ministry of Home Affairs regarding policies for these cases when arranging administrative units.
Because part-time workers at the commune, village and residential group levels are not included in the group of subjects subject to and are not entitled to the regime as prescribed in Decree 178 on policies and regimes for cadres, civil servants, public employees, workers and armed forces in the implementation of the organizational arrangement of the political system as well as Decree 67 amending and supplementing a number of articles of Decree 178.
If applied according to Decree 29/2023/ND-CP, because the monthly allowance for non-professional workers at the commune, village and residential group levels is currently not high, the subsidy level for these subjects who are redundant due to the arrangement of administrative units at the commune level will be very low.
Receiving the opinions and thoughts of non-professional workers, recently at the meeting of the National Assembly Standing Committee on April 17, Minister of Home Affairs Pham Thi Thanh Tra said that the Ministry of Home Affairs is consulting to have more policies for non-professional workers who retire in accordance with the general direction of competent authorities.
