According to the draft Law, Vietnam's administrative units include provinces and centrally-run cities (provincial level) and grassroots levels including communes, wards, and special economic zones on islands. Special administrative-economic units will be established by decision of the National Assembly. Special economic zones on islands will be established by the National Assembly Standing Committee.
Based on the two-level local government model, the Ministry of Home Affairs proposes that the provincial level focus on issuing mechanisms, policies, strategies, planning, and macro-management. Issues of a regional and inter-base nature that exceed the capacity of the base, require deep expertise, and ensure consistency are also undertaken by the provincial level. The tasks and powers of the current district level (before dissolution) that exceed the capacity of the base level (after reorganization) will be transferred to the provincial level.
The grassroots level will implement policies from the central and provincial levels, focusing on the task of serving the people, directly solving problems of the community, providing basic and essential public services to the people in the area; tasks that require community participation, promoting the initiative and creativity of the grassroots level.
Accordingly, most of the current tasks and powers of district-level governments will be transferred to the grassroots level. Most of the tasks of district, provincial city, city under central city, and town governments will be transferred to wards.
According to the Ministry of Home Affairs, this proposal aims to solve administrative tasks and provide essential public services to people with the principle of prioritizing the grassroots level. If the grassroots level performs well, then decentralization will be implemented, except for tasks beyond their capacity, which will be transferred to the provincial level.
To implement the principle of "local decision, local action, local responsibility", the Ministry of Home Affairs proposed that the provincial level will promote decentralization and authorization to the grassroots level to improve governance capacity, increase the effectiveness of state management, and promote local socio-economic development.
Through review, it is expected that 85% of current district-level tasks and powers will be transferred to grassroots levels for implementation.
