On the morning of November 10, Minister of Public Security To Lam, on behalf of the Government, presented the Government's Submission on the draft Law on Road Traffic Order and Safety.
Stating 6 practical bases for the need to promulgate the law, Minister of Public Security To Lam emphasized that although the situation of road traffic order and safety in recent years has changed, it is still complicated, traffic accidents are still high and serious, especially the number of deaths, always posing many potential risks to people and vehicles participating in traffic.
According to statistics, on average, nearly 9,000 people die and nearly 30,000 people are injured every year, mostly of working age, directly affecting socio-economic development.
"Traffic violations are still common, and traffic culture is still weak. Human security in the road traffic sector has not been guaranteed," Minister To Lam emphasized.

One of the main reasons is that many regulations in the 2008 Road Traffic Law have revealed limitations and inadequacies, failing to meet the requirements of management in this field, especially in the face of the development of traffic infrastructure, the rapid increase in the number of vehicles and the situation of order and safety of road traffic in Vietnam.
In reality, when investing and constructing infrastructure to implement road traffic infrastructure investment projects, many difficulties arise in terms of legal basis. Road transport currently has to assume a large proportion, which is not balanced with other modes of transport; driver management is still inadequate; there is a lack of database to strictly manage drivers in the transport business...
The draft law has 11 articles regulating: Conditions for drivers participating in road traffic; driving licenses; age and health of drivers participating in road traffic; driver training; driver testing...
General To Lam said that the draft has added a number of new regulations in line with the trend and progress of digital transformation, creating convenience for people.
Accordingly, for one of the following documents: driver's license, vehicle registration certificate, inspection certificate, compulsory civil liability insurance certificate, in case the information of any of these documents has been integrated into the electronic identification account or identity card as prescribed, it is not necessary to bring it.
The Draft Law does not divide the driving license categories in detail like the 2008 Road Traffic Law, but only stipulates the principles for classifying driving licenses to ensure flexibility in case of changes in relevant international treaties of which Vietnam is a member.

Presenting the review report, Chairman of the National Defense and Security Committee Le Tan Toi said that some opinions suggested considering a regulation that would absolutely prohibit people from “driving vehicles while having alcohol in their blood or breath”. Some other opinions agreed with this regulation, as its effectiveness has been proven in practice.
There are suggestions to add some prohibited acts such as: fleeing after causing a traffic accident to avoid responsibility; intentionally not providing first aid or assistance to traffic accident victims when having the conditions; infringing upon the life, health, and property of the victim and the person causing the traffic accident...
“It is recommended to study the above opinions to absorb them appropriately; continue to review and arrange the prohibition regulations to ensure consistency and logic, avoid duplication with other regulations in the draft law or duplication with regulations of other specialized laws,” the review agency requested.

Regarding vehicles participating in road traffic, some opinions suggested considering regulations that motor vehicles and specialized motorbikes participating in traffic must meet the conditions of "having a journey monitoring device; a device to collect data, images of the driver, data, images to ensure journey safety according to regulations" because they believe that applying it to all types of motor vehicles is too broad and difficult to ensure feasibility.
According to Mr. Le Tan Toi, some opinions said that after the National Assembly issued the Resolution on piloting the auction of car license plates, although the pilot implementation time was not long, it initially proved the effectiveness and feasibility of this new policy, therefore, it is recommended that it be soon stipulated in the draft law to ensure compliance with the provisions of the Constitution.
Some other opinions suggested that the pilot period should be long enough to have a sufficient basis for evaluation, summary and reporting, and propose that the National Assembly complete the law at the first session of 2026.
The National Defense and Security Committee proposed that the Government promptly report to the National Assembly on the results of the implementation of Resolution No. 73 dated November 15, 2022 of the National Assembly so that National Assembly deputies have a basis for consideration and decision.
Regarding driving license testing, Mr. Le Tan Toi said that many opinions suggested adding regulations on state management after driving license testing; at the same time, adding regulations on irregular inspections of training, testing, granting licenses, reviewing testing results, and granting driving licenses to ensure strictness .
